I'm Tom Donovan, topping our news this half hour. Trouble continues for President Clinton with members of his own party. Some powerful Democrats who represent oil and gas states are fighting the president's proposed energy tax. Now at first the opposition was just coming from Democrats in the House, now Senate Democrats are speaking out. NBC's Andrea Mitchell reports from the White House. You might ask why is this man smiling, since the latest defector is a key Democrat on the Finance Committee that must act on the president's tax plan. David Bourne proposed fewer taxes, more spending cuts. This plan represents a third option in addition to the acceptable, unacceptable choices of either doing nothing about reducing the budget deficit or reducing it mainly through tax increases. Not surprisingly oil staters like Oklahoma's Bourne want to eliminate the president's energy tax. It is a regressive tax. It is filled with exemptions, exceptions, would be a boon for lawyers and bureaucrats and delays. Instead Bourne's group proposes reducing annual social security cost of living increases for 22 million Americans, delaying tax increases on the rich, capping government benefits programs. Basically a 40 billion dollar shift away from wealthy Americans right on the people just above the poverty line, the elderly and the working poor. I don't think that's, I don't support that. Bourne doesn't have the votes to pass his plan, but without his vote the president won't be able to get his own plan out of the Finance Committee. We don't have the vote right now. Not having the votes right now is irrelevant because the committee is not going to vote right now. But if Clinton starts making concessions to pick up Bourne's support in the Senate, the fragile coalition he's put together in the House could fall apart. House leaders are very nervous and Republicans know it. I wonder if the Majority Leader might have any thoughts and whether something like the Bourne-Danforth elimination of the energy tax, which might occur in the other body, creates the opportunity for us to eliminate it here first rather than allowing them to get all the credit. Right now the momentum is going against the president in the Senate. To save his energy tax he's going to have to figure out how to satisfy Senate conservatives without losing House liberals. Andrea Mitchell, NBC News at the White House. The Clinton administration stands by its decision to fire its travel office staff. Spokesperson George Stephanopoulos said Wednesday's firings followed complaints passed on by Hollywood producer Harry Thomason, a Clinton family friend. Thomason told the president that the travel office failed to go through a bidding process when chartering aircraft used by the news media covering presidential trips. But the fired head of the travel office said the dismissals are unfair. I have not stolen anybody's money. The guys in my office have not stolen anybody's money. And some Republicans are unhappy as well. Missouri Senator Kit Bond sent Mr. Clinton a letter saying he is concerned that the accused were not allowed to defend themselves before being fired. Military officials on Thursday grounded all VH-60N Black Hawk helicopters in the presidential fleets. Military officials say the grounding is a precautionary measure. The order follows the crash of a Black Hawk helicopter on Wednesday which killed four crew members. Straight ahead on NBC Nightside, a battle over a baby in California. The meeting comes amidst reports that America's allies are near agreement on what to do about the continuing civil war. Secretary of State Warren Christopher began the talks with Kossarov Thursday. Today's New York Times reports the US and Russia agreed to forge a common strategy with other European nations. The strategy accepts territorial gains made by Serbs rather than asking them to give back the land they took in fighting. Sniper fire was at a minimum yesterday in Mostar after Bosnian, Croat and Muslim leaders signed a ceasefire Tuesday. This amateur video shot the daily agreement was signed it shows some of the damage caused by recent fighting. Keeping with the agreement the Croat troops have released 1,800 Muslims captured last week. The peace did not prevail in the Bosnian capital of Sarajevo. One woman was killed and seven injured in an hour-long mortar attack on the city. Michigan's ban on assisted suicide was struck down on technical grounds by a circuit judge on Thursday. This is a further setback to the state's effort to stop Jack Kevorkian, the so-called suicide doctor. Kevorkian was present at a 16th suicide Sunday, the first since the law took effect. The judge ruled the state lawmakers unconstitutionally added the measure to a bill dealing with a narrower issue. A landmark decision out of California Thursday, the state Supreme Court there ruled a woman who was paid by a couple to bear a child has no parental rights over the baby. The court said she is a genetic stranger to the child. Linda Alvarez explains. This is the baby in question Christopher Calvert seen here when he was about a year old and these are his genetic or test tube parents Mark and Crispina Calvert. Three years ago they paid this woman Anna Johnson $10,000 to give birth to their son but a few months before he was born Johnson claimed a bond with the child and threatened to keep the baby. I will fight until there is nothing left in me to fight with to save my baby. The case has been in the court ever since Christopher was born September 1990 but California's highest court ruled in favor of the genetic parents not the surrogate mother. With this judgment Anna Johnson is not the mother of his child and therefore does not have any claim towards visitation or custody. Here's what the state Supreme Court ruled the party's aim was to bring Mark and Crispina's child into the world not for Mark and Crispina to donate a fertilized egg to Anna and that Anna Johnson is a genetic stranger to Christopher Calvert. Johnson made no public statement but her attorney did hold a press conference and read a rambling letter to President Clinton about the breakdown of due process. The state and local bar associations unethically inspired to obstruct justice and interfere in the precious due process rights for which this country stands. Shame on them. The Calvert's didn't show up to make a public statement they're very protective of their sons and their family's privacy but their lawyer very vividly described their joy. Mark was ecstatic this he expressed to me that this has been a tremendously stressful three years for him he suddenly felt a great burden taken off his shoulders I heard Crispina in the background yelp with joy and Mark told me that he was gonna leave me so he could just hug and kiss his child. President Clinton is stepping up his search for a replacement for retiring Supreme Court Justice Byron White the eight other justices are all Republican appointed with the chance for Democrats to put a mark on the court the president is getting a lot of advice NBC's Pete Williams has more. Dozens of names are on the Washington rumor circuit but White House sources tell NBC News that President Clinton is concentrating on five finalists three are federal judges Jose Cabrana's chief judge of the district of Connecticut Stephen Breyer chief judge of the First Circuit Court of Appeals in Boston and John Newman of the Second Circuit Court of Appeals in Hartford Connecticut and to our state Supreme Court justices Shirley Abrahamson of Wisconsin and Christine Durham of Utah Bill Clinton is the first Democratic president in 26 years to nominate a justice and he's getting plenty of advice for some court scholars the choice is clear a liberal court is so heavily stacked toward the very conservative side on such issues as abortion church state federal and state power that I think it does need balance Hispanic groups want Judge Cabrana's a native of Puerto Rico who grew up in the South Bronx we think that a Hispanic American can bring to the court many advantages a unique perspective and sensitivity that has been absent for the court in entire history the Senate Judiciary Committee will hold hearings for the nominee and the committee's ranking Republican pledges fair treatment I do not want President Clinton's nominees to go through the horrendously slanderous and libelous and dirty approaches that were used against the nominees of presidents Reagan and Bush that
