You're watching KXAN Austin News at 10. A blanket of moisture hanging around town today, but few raindrops falling. But Jim Spencer's forecast is full of storm potential, Jim. And we're getting reports that that fog is returning tonight. And here's why Rockdale Junior High School, as an example, 100% relative humidity. There is a warm front moving north tonight and on the north side of a warm front, you can get plenty of fog and some drizzle. It was a mild day today. Look at our high temperature in Austin, 7980 out at the airport. Our temperatures are near that right now at 77 degrees here in the city. We've actually seen warming temperatures in the last couple of hours here in the metro. But that cold front right there tomorrow afternoon will be changing things up again by tomorrow evening, including a risk of some strong to severe thunderstorms in our area. We'll detail when and where those could form and we'll take a look at still more rain in your seven day forecast coming up in first warning weather. Independent eyes detect a bias at Austin's police department towards protecting its officers. An outside review finds some faults with the internal affairs investigation into the death of Nathaniel Sanders. An APD officer shot him back in May. The city released the report today with some pages heavily redacted. Shannon Wolfson is live down at APD headquarters tonight with the new details for us tonight. Shannon. Now, because a large portion of this 133 page report by Key Point Government Solutions is redacted, it is not clear what this independent review says about Officer Leonardo Quintana's actions back on May 11th. However, it is clear this independent review panel is very critical of APD's investigation into that shooting. Back in September, the Citizens Review Panel and the Police Monitor's Office called for an independent review of this May 11th shooting. Officer Leonardo Quintana shot and killed 18-year-old Nathaniel Sanders in the parking lot of the Walnut Creek Apartments in East Austin. Now, parts of that review are open to the public. It found the initial investigation by APD homicide detectives was competent and reasonable, although there were quote, substantive deficiencies. But it found the internal affairs investigation to be biased toward the officers involved in a way which undermines the credibility and confidence of both the department and the public. And it found significant deficiencies in the quality of documentation relating to the training of APD officers. If it is true that the internal affairs investigation was biased, that raises some very troubling questions about whether the public can trust APD to investigate officer-involved shootings. Attorney Adam Loewy represents the Sanders family in their civil lawsuit against the city and officer Quintana. A Travis County grand jury declined to indict Quintana, clearing him of any criminal wrongdoing in the shooting. But the independent review appears to question Quintana's decision to approach the vehicle without sufficient backup. It repeatedly states that Quintana knew the vehicle was suspected in a string of armed robberies. The finding of bias and undermining public trust in APD's ability to investigate their own was the very reason for a Department of Justice review just one year ago. That's why the federal government got involved. And sadly, this is yet another example of a question about whether APD can be trusted when it comes to police officer shootings. The Citizens Review Panel met today to discuss this review. They will make recommendations to Chief Art Acevedo regarding discipline for Officer Leonardo Quintana. The chief by law must make any decisions regarding discipline by November the 7th. APD would not respond to the report today. However, we are expecting to hear more from them about it tomorrow. Shannon Wolfson, KXAN, Austin News. Thank you Shannon. Well this week Travis County prosecutors are pushing for the death of Paul DeVoe. The sentencing phase began today in his trial for killing Daniel Hensley and Haley Faulkner. Despite a jury finding him guilty on Friday, DeVoe walked into court clean shaven and with a smile today. Jurors heard nearly a dozen people testify, some from DeVoe's past, talking about his alcoholism, assaults and his criminal behavior. The last testimony the jury heard before recessing for the day was from the mother of a man he's accused of killing. There's a hole in your heart that's just gone. You can't replace it. There's lots of good memories but the physical presence is just unbearable. DeVoe's attorneys have not indicated who will take the stand in his defense. One suspect down, three to go in the shooting death of a 22-year-old in North Austin. Marvin Thurston turned himself into authorities today in Kentucky. He was wanted in connection with the death of Michael Carmichael back on September 26th. Austin police are still looking for three other suspects. Mario Higgs, Ontario Maddox, also known as Roe, and Jason Maddox, aka Stevo. A judge says there's enough evidence to continue the case against a Jordanian teenager accused of trying to blow up a Dallas skyscraper. Investigators say 19-year-old Hossam Samadi drove a truck he believed held a live bomb and parked it in a garage underneath a 60-story fountain place building on September 24th. Later, they say he dialed a phone that he thought would ignite a blast there. If convicted, Samadi faces up to life in prison. President Barack Obama has invited a group of congressional leaders to the White House tomorrow to discuss the war in Afghanistan. White House says it may take the president weeks to decide whether to send more troops. But spokesman Robert Gibbs says one option not on the table is walking away from the conflict. Half of the staff at a Georgetown business is under arrest for ripping off customers to the tune of more than $100,000. Police say Georgetown Homes was the base for an organized crime ring in Williamson County. The mobile home and land sales company is in South Georgetown off of I-35. General Manager Tammy Austin was hired by Georgetown Homes owner Chad Denton to clean up the mess. She says former employees ripped off up to 60 customers. And when the owner found out, he fired the employees and notified police. He felt it was the most important thing to get these people paid back and made whole again. And so he liquidated assets and cashed in 401K and basically paid back everyone. Georgetown police found nearly $129,000 had been taken from customers buying manufactured homes and land from November of 2006 to this past April. If convicted, each of the five suspects faces up to 20 years in prison. An elderly woman who was shot with a taser by a deputy constable, except a $40,000 settlement from Travis County. Deputy Constable Chris Bayes pulled over Katherine Winkfein back in May after he clocked her going 60 in a 45 mile per hour zone. The deputy shocked her when she argued and struggled after refusing to sign the speeding ticket. Winkfein was charged with resisting arrest. After squabbles with the city council, Lakeway's police chief officially stepped down from his post this afternoon. Chief Gordon Bowers accepted a settlement agreement with the city to take early retirement. Their conflict started when he asked for an investigation into the actions of two city council members. Bowers says he doesn't agree with the findings of that investigation, but that today's decision allows him to leave with his rights intact. It's a combination of pride and having my heart ripped out. Bowers has a legal right to revoke the agreement within seven days, so it won't take effect until next Monday. Lieutenant Todd Radford is currently the acting chief in Lakeway. With the first H1N1 vaccines going out today, there's still a lot of confusion about who needs what, when, and how much. From infants to elderly patients, we'll outline the recommendations in detail coming up. Plus, what it's going to take to clean up all that mud in Zilker Park. U.S. Senator Kay Bailey Hutchison picked up the coveted endorsement of the Texas Farm Bureau's political arm today in her race against incumbent Governor Rick Perry. Senator made an appearance in Allen's boots today on South Congress. The Farm Bureau president cited her record in dealing with property rights, the Endangered Species Act, and the Farm Bill, among other issues. The Bureau has 421,000 Texas members. Less than a week after a hacker sabotaged Governor Perry's online address, the FBI announcing today it's stepping in. The disruption came during a reelection announcement last Thursday in San Antonio. The FBI says it's conducting a preliminary inquiry into what could be an international intrusion from some, intentional intrusion rather, from someone outside the state of Texas. The street in front of the Texas governor's mansion could stay closed permanently. State security officials want to keep Colorado Street closed as part of the mansion's restoration. The street has been off limits to cars and pedestrian traffic since the June 2008 arson fire that gutted that mansion. Some Austin City officials and historical preservationists are questioning whether the closing of that street would significantly help to protect the mansion's security. Well, we saw a little fog and drizzle today, but no rainfall, so zero the total at Mabry, zero at ABIA. Over the weekend, just two-thirds of an inch at Mabry and nine-tenths of an inch at the airport. You folks at ACL don't know how lucky you were. Had three to five inches up in the North Lake Travis area over toward Round Rock. Had six inches down toward San Marcos. But despite that rainfall, Lake Travis just came up a couple of inches and now is steady again and will begin falling likely tomorrow. Lake McKinnon about the same. Now they concentrate mostly on folks who are uninsured, other folks who are on government assistance. There's not a lot they can do right now without the vaccine yet to arrive. From 7 in the morning to 7 at night, the phones don't stop. 2,400 calls today alone. Many or most regarding the flu. The LSCC hotline is designed to get those patients into the quickest available treatment. They can call one number and by calling that one number they have access to all of our clinics. If they can't get into the clinic that they're most typically seen at, this allows them access to the other clinics. They might be able to go to Granger or Georgetown or Round Rock in the next available appointment. At those clinics, they're anxiously awaiting the vaccine. Do any day now. Without it, there isn't much they can do. We're treating them symptomatically with treating the fevers, telling them to drink lots of fluids, rest. Of course, high risk groups, pregnant women, people who have other medical conditions, we are treating with antivirals like Tamiflu. But how many vaccines do you need? Doctors say it depends. High risk adults and children need both. If you're a healthcare worker under the age of 25 or if your children is under six months, you're at risk. Get both vaccines. Pregnant women and chronically ill adults are also at risk but need the shot, not the spray. Babies under six months cannot get any vaccine. Children over 10 get one H1N1 vaccine and one of the regular. Children under 10 need two doses of the H1N1 and regular flu shots. These are two different viruses that could be circulating together throughout the community. So if you're protected against one, you would not be protected against the other. And the first batches of the vaccine are expected to be in Texas by the end of the week. It will be distributed by the state. Based on our population, they say we will have 40 million doses here by the middle of October. David Scott, KXAN, Austin News. Now first morning weather with Jim Spencer. Well moisture hanging in the air over our Capitol complex and the University of Texas campus but no fog in the Austin area. Same can't be said for areas north of Austin tonight. More on that in a minute. It's mild, 77 degrees is the current temperature in the city. We're actually two degrees warmer than we were at 8 p.m. tonight. Doesn't usually work that way at night and it could get even warmer overnight. Temperatures out in the hill country, low and mid 70s to the east, 80 degrees right now in LaGrange, 79 in Lockhart, 81 in San Marcos. There's a warm front lifting our way right now which explains why it's a bit warmer to the south. By seven o'clock in the morning where at least 77 maybe be up to 78 or 79 degrees. Maybe some light fog but I think the fog should lift overnight as that warm front lifts to the north. We're at 75 degrees by noon, a warm midday with partly sunny skies. We could see some thunderstorms though as early as late afternoon approaching the metro area. If not then certainly into the evening hours as a cold front approaches and we could get to 90 to 92 degrees tomorrow before that front gets here. 77 in the city now, 77 mostly cloudy out at the airport. Winds are east southeasterly in the city at 6 and east northeast wind at 7 miles per hour at ABA. Mold medium and ragweed medium today. After allergy forecast for Tuesday I bet the mold is back into the high category. Ragweed likely staying at a medium concentration. And you can see that a warm front lies across the state tonight. 60 is up in the Dallas area, low 80 is down in the San Antonio area right now. In fact that front again lies just south of the metro right now. It's already lifted into Hays County, already lifted up into a Caldwell and Fayette County tonight and it'll continue to make progress on to the north. Not rainfall with the front but some patchy drizzle, certainly a possibility. Tomorrow the front's way out of here but a cold front starts coming down through northwest Texas. A front that's making it snow tonight in the mountains of Colorado. Now it will not get that cold here but it could trigger some strong thunderstorms as early as mid afternoon tomorrow in our Hill Country area if not even by early afternoon. Now let's go into the evening hour by hour. Here we are at 6 o'clock tonight. We're showing a line of thunderstorms extending on down to at least the northwestern parts of the metro area up into northeast Texas. Then the storms will march on down to the southeast by morning. Wednesday should be mostly dry. The Hurricane, or the International Storm Prediction Center puts us in the slight risk area for severe thunderstorms tomorrow. Hill Country metro area and our northeastern counties. We'll have to keep an eye on it. The atmosphere's going to be a little bit unstable. Large area below pressure out over the western United States kicking out one disturbance tonight that's moving right up here. That's what will drive the front into Texas tomorrow. Then another storm system, the main one will sit back here. It'll kick out on Thursday sending another cold front down our way. That front likely to bring us a good chance of rain and thunderstorms certainly by Friday morning if not earlier. Very interesting in the tropics tonight. That is or was Tropical Storm Grace southwest of Ireland by about 200 miles formed very, very far to the northeast in the Atlantic Ocean. Hurricane Center tonight though says it's being absorbed by a cold front. They've issued their last advisory. That's a tropical wave here in the Atlantic that's moving toward the Caribbean Sea. Hurricane Center says up to a 50-50 chance that that could become a tropical depression. What a quiet year out there in the Atlantic and Caribbean and Gulf. Low and mid 70s for your low temperatures tonight. Maybe even mid to upper 70s in some places tomorrow. Upper 80s, maybe low 90s, almost hot in the afternoon and then that chance of some storms tonight. Some areas will continue to see some fog. I think it lifts by morning though as the warm front moves through 76 the low. Tomorrow we could get to 92. A south wind at five to 10. Then those afternoon showers and thunderstorms begin forming. What's the chance of rain where you are tomorrow? Well, I would say at least 50 percent mainly afternoon and evening. 40 percent chance of a few lingering showers on Wednesday. Thursday about a 30 percent chance of rain. Notice we're cooler Wednesday. Warm again Thursday. Then cool on Friday. But that system Friday is the main show. And that's when we have a good chance of rain and storms and it clears out of here and leaves us behind with some really nice weather this weekend and early next week. We'll wake up in the morning and see if any of that fog or drizzle will slow your commute into work. We'll bring the weather and traffic together every 10 minutes on Austin News Today starting at five. And Austin City workers now have the huge task of reviving Zilker Park after a wet ACL Festival weekend turned it into a muddy music pit. Most of the mud that surfaced above the grass was so-called dillo dirt. That's a compost made by the city of Austin from yard trimmings as well as some treated sewage sludge. The good news, Austin Parks and Recreation officials believe the grass they just put in there this year can still be saved. Probably with hoses and perhaps shovels, just remove the mud from the grass. We think the grass is under there and we think it's still alive. Austin Parks officials say it could take weeks to get Zilker Park cleaned up. Ben Harper, Meg Ryan and Laura Dern among the celebrities saying goodbye to the live music capital this morning out at Austin's airport. There they are. The trio trudged through security just before 10 this morning. No doubt among thousands of others wrapping up a weekend full of music here. We'll expect to see more Alamo Drafthouse cinemas popping up all over Texas. Triple Tap Ventures just bought the franchise rights to the unique movie theater concept. They're planning expanding to San Marcos, Amarillo, Corpus Christi, Lubbock and Midland Odessa. Alamo Drafthouse co-founders Tim and Kerry League retained control of the three Austin locations when they sold the franchise operation to other investors in 2004. The Toyota Motor Corporation officially recalled 3.8 million vehicles in the U.S. today. Trying to address problems with floor mats that could cause the gas pedal to get stuck and cause a crash. Some students at the University of Texas School of Business are getting some real world auto industry experience. The Ford Motor Company was at UT today challenging students to come up with ways to find buyers for a car being reintroduced into the American market. They'll be presented with the target customer that will be buying the Ford Fiesta when it's launched here in the United States. And we'll be asking them to come up with a marketing plan to really go after those customers. Students are encouraged to incorporate social networking sites in their marketing to reach consumers who might not connect to traditional advertising. Up next for the Longhorns, Colorado.
