A judge in the state of New Hampshire rules in the case of Jesse Murabito. She is the woman from that state that fled with her children on the day her ex-husband was found innocent of raping their young daughter. The 16's Jeff Torsch has been following this story and he has this report on today's development. New Hampshire District Court Judge Douglas Gray today ordered Jesse and Rusty Murabito's six-year-old daughter and four-year-old son return to that state. The judge said his court has jurisdiction in the case. He also said that the children would be placed in a foster home until custody could be determined, that both parents would only be allowed to visit the children under supervision, and that Jesse Murabito would not be prosecuted for an outstanding civil warrant issued in New Hampshire at the time she fled with the children. Yesterday, Choteau County Judge John Warner opened the door for today's action. Rusty Murabito and his lawyer left the Montana courtroom immediately following yesterday's hearing headed for the airport. Their objective? Get back to New Hampshire as quickly as possible to get the ball rolling for a New Hampshire judge to issue today's ruling. It would appear that they were successful. For Jesse Murabito, yesterday's partial victory was short-lived. I am very relieved that Judge Warner has taken steps to ensure the safety of my children. Choteau County Attorney Tom Sheehy said probably nothing will happen until early next week. Both Jesse and Rusty Murabito were unavailable for comment. Jeff Tourish, News 16. It's important to note that this may not be the final word on Montana's involvement in the Murabito case because Judge Warner is not bound to accept the ruling from a New Hampshire court. A local paralegal has been found innocent of engaging in business without obtaining a business license. City Judge Robert Tucker made the ruling today and also dismissed the case against David Doran. The City of Great Falls brought charges up on Doran in March for doing business that they thought required a license. Doran at the time was working for an attorney on a criminal felony case. He was employed as an investigator. Doran is a paralegal. The city claimed that he was not a state licensed private investigator and therefore could not obtain a city license as a private investigator. There was a lot of discussion within the case about what a paralegal is qualified to do or not do when acting in that capacity for a licensed attorney. In the end, Judge Tucker ruled that a paralegal does not require a city business license. The owners of the burned Scan-Am building have decided to rebuild. According to Scan-Am sales manager Jim Whitaker, the damaged portions of the building were torn down today and building owner Peter Madsen hopes to be in a rebuilt building on the same spot within six months. The building at 205 Ninth Avenue South was virtually destroyed by fire on the evening of July 27th. Until the new building is erected, Scan-Am furnishings is operating out of one of the Montana plumbing buildings across the street from the burned Scan-Am building. Meanwhile, Fire Marshal Dick Swingley told KTGF today that he is ruling out arson as the cause of the fire at this time. Swingley says he's almost finished with the investigation and plans on conducting his final interviews next week with building owner Peter Madsen, Madsen's wife, and Scan-Am employees. Swingley said following the interviews, he'll have an exact or at least a probable cause of the blaze. He told KTGF he does know where in the building the fire originated, but will release that information when he releases the cause. Damage from the fire has been listed in the millions of dollars. For the Montana Lottery, 13 was not an unlucky number. The 13th instant winner game, Centennial Gold, was the first one in the two-year history of the lottery to record a sellout. Lottery director Chuck Brooks says the lottery headquarters in Helena have sold all 2.2 million tickets in the game. However, most retail lottery outlets still have two weeks of tickets available. Brooks says a new game will be launched August 30th. The lottery director says sales are up significantly over a year ago. Brooks credits additional prizes in the Centennial Gold game. In contrast to earlier games, when 45 percent of the tickets were winners, the latest one boasts a 55 percent payout. Just ahead in World Headlines, a veteran solidarity activist is targeted to lead Poland's next government. We'll have details, but first a look at how Wall Street closed for the day. Tonight in World Headlines, a solidarity leader in Poland. It's looking more and more like the clock is ticking away in the final hours of communist domination in Poland. Veteran solidarity activist Tadeusz Mazowiecki confirmed that he's President Wojciech Jaruzelski's choice to lead Poland's next government. Amazingly calm, that's how the pilot of United Flight 232 sounded as he spoke with an air traffic controller before he crash landed in Sioux City, Iowa last month. According to tapes released today, the pilot had to experiment with engine speed and landing locations just before he finally brought the plane in for a landing. At one point, the air traffic controller told the pilot to land on a nearby interstate highway. And the St. Louis area auto body shop could use some body work itself after a piece of an engine from a TWA airliner ripped through the roof of the North Country auto body and parts today. The shop's manager says the plummeting airline debris missed him by 15 feet. Let's look at news around the world for this Friday. Three Montanans are not happy about paying entry fees at state parks, so they filed a lawsuit against the Department of Fish, Wildlife and Parks. The lawsuit claims the state broke a contract with senior citizens by invalidating special permits that give them free lifetime access to parks. The lawsuit seeks a court order barring the collection of fees from those who have a Montana State Golden Years pass. The suit also seeks reimbursement by the state to any pass holders who have had to pay an additional fee. Giant Springs Heritage Park in Great Falls was found exempt from the fee system since so many families and younger children utilized the park. The state enacted the fee system because the state did not have enough money for parks maintenance. A hiker was attacked by a grizzly bear this afternoon in Glacier National Park. The pole bridge man was attacked by the bear about three quarters of a mile from the loop trailhead along Going to the Sun Highway. Glacier National Park spokeswoman Amy Vanderbilt says Donald Sullivan suffered a bite wound in his lower left leg and other minor cuts and abrasions but was not seriously hurt. When he reached the trailhead, Rangers administered first aid and Sullivan was taken to a hospital in Whitefish. Vanderbilt says Sullivan was with a group of hikers when they heard a rustling in the bushes and the grizzly charged. She was accompanied by two subadults, offspring believed to be about two years old. As a result of the grizzly attack, Vanderbilt says the loop trail to Granite Park was temporarily closed as were the Granite Park campground and the Packers Roost horse trail nearby. inating the game. The Almanac in Great Falls, today's high 75, the record high 101 in 1987, today's low 45, the record low 40 in 1964, the sun will rise tomorrow at 625 and set tomorrow evening at 833. Taking a look at our jet stream map, we see the troughs still pretty much over Montana, bringing us our cooler temperatures, but for the weekend, we will start warming up as this ridge starts pushing eastward into Montana. Scattered clouds along the four corners area into parts of Nevada, Utah, and New Mexico, and also Arizona. Moving eastward, lots of warm air in the central part of the United States, as well as some cloud cover. You can see the northern parts of Louisiana and the eastern parts of Texas extending all the way across most of the upper Ohio Valley, Tennessee Valley, and the lower Mississippi Valley. Also, a few light scattered cloud covers over the mid-Atlantic states. Taking a look at today's map, lots of cloud cover and lots of rain for the eastern half of the United States. Williamsburg, Virginia got 11 inches in about four hours today. They've just been drenched in the eastern part. It's a stationary front that just doesn't seem want to move, just keeps giving them more rain. Also, some thundershowers down in northern parts of Florida. Sunny skies, though, for the midwestern states, and a few rain showers in the four corners area. Also, in the Dakotas, there's this low move eastward through the Dakotas and out of Montana. It was kind of hooked up on the eastern part, giving them some cooler weather over there. It has moved on, and we're still having some cooler weather, though, as the low is also in the southern parts of Canada. It is weakening and moving eastward, but we're still getting some more cool temperatures out of that. Today, from that, the western part of the Devi of Montana had sunny skies, and the eastern part had partly cloudy skies, and a few rain showers along the southern part. That's about the same for tonight and tomorrow. Southeastern Montana will have some rain showers. The rest of us, partly cloudy skies with very widely scattered showers. Sunny skies, though, in the desert southwest. That's where the high in the nation was today, in the state of Havasu City, Arizona, the low this morning, in Truckee, California, at 33 degrees. Taking a look at tomorrow's map, you can see the low moving further even out of the Dakotas into the Great Lakes area and the western part of the Midwestern area. You can see here some rain showers going along with that. Scattered rain showers behind that in the four corners area in the western parts of Texas. Still clear, though, here in the eastward and midwestern part into the Tennessee Valley and parts of the Ohio Valley. The stationary front still staying along the mid-Atlantic coast, giving some more rain showers, extending now into central and southern parts of Florida. Taking a look at our own area, though, you can see clear skies behind us. There is a Canadian high pressure ridge that we'll start building about Saturday, and what that means is we're going to get some cool air out of Canada, but high pressure also bringing up air out of the southwest, so we're going to get some warm, but not too hot air. We're going to stay about in the 80s for the weekend with a few widely scattered showers in the afternoon and evenings. Lows tonight are going to be in the 40s and 50s, high tomorrow in the 70s. On that day in a Columbus courtroom, the lawyers for the Reds manager and those representing Major League Baseball along with Bart Jumati will present their cases before Federal Judge John Holshue. The issue is this, Rhodes wants to keep the Commissioner of Baseball from ruling on charges of gambling by Rhodes. Pete claims that Bart has his mind already made up on the issue, and that Rhodes is guilty of betting on Big League games according to the Commissioner. Meanwhile, it will be Judge John Holshue who will determine if Jumati is indeed biased in that case. Another Big League happening, Dallas Green manager of the Yankees fired today by owner George Steinsbettter. The Finch drives only sixth place in the AL East, taking over the Yankees Bucky Dent. This is the 17th managerial change for New York in the last 16 years. On to pro football, Chicago Bears trading quarterback Jim McMahon to the Chargers for a conditional draft pick. The draft choice will depend on how much and how well McMahon can play for the Chargers this season. The pick could be as high as number one, but no lower than a number three. Jim's record as a starter for the Bears, very impressive 49 wins, 17 losses. McMahon says he saw the trade within the work from the time training camp started this summer. Now it's on to golf, day two of the mid-amp tourney in Bozeman at the Yellowstone course. Gene Cook of Great Falls who led this three-day event after one round, slipping to third place today. His round of 77, leaving him at 148, four strokes behind the leader Ed Dorff full of billings. This tourney will conclude tomorrow. Staying with local sports and the local sports team, the ice at the Four Seasons Arena serving as the backdrop for the Great Falls Youth Hockey Association summer camp. Several coaches from Canada conducting the sessions that began Monday and conclude tomorrow with scrimmage action, the instruction covering all phases of the game. The attitude, you have to approach anything in life with a proper attitude. So we really stress attitude and we're very strict on discipline and the way we want them to act on and off the ice. Once the positive attitude has been put forth by the coaches and reflected in the players actions, it's time for Bill and the other instructors to enhance the on-ice skills of the young hockey players. Basically we run a balance and agility program to get the kids a little more comfortable on the ice as compared to what they are right now. So our theme is like we say, you walk around the streets in your shoes and you feel comfortable, you never fall down, you get on the ice and skate on those thin edges and you feel a little awkward. So balance and agility is going to get you feeling like you're just walking on cement with your pair of shoes on and that's the whole idea, the concept, that's what we try to get across. Another concept that Bill and the other instructors try and emphasize at this and many of the other camps that they work at is that the game of hockey should be fun for these budding Mario Lemieux or Wayne Gretzky's. Take the game for what it should be, a fun game, and enjoy it. As far as progress goes, Bill emphasizes that progress right now in the skill level is not that essential. Over the week you don't see that much improvement. Conditioning wise is the biggest thing, but over the last five years there's been quite an improvement in the skill level and the way they play the game, the thinking part of the game, you've really seen a big difference. Again, the hockey camp, including tomorrow morning and tomorrow afternoon at the four seasons with their overall scrimmages, they look pretty good today. Alright, and I hear there's another scrimmage going on for high school football this weekend. Rankin who was from Montana was the first woman in the country to be elected to the United States Congress. This weekend Rankin will tell you about her life through a narrative skit acted out by Judy Hyatt. She did many many things in her lifetime that we don't really know about now. I learned a lot about her when I was researching for this play. But she also was very active in getting rights for women married to men of another country. That they could retain their United States citizenship. She was also very concerned about child labor laws. Also this weekend Stockett, Centerville, Stankoolly and Tracy will celebrate the state centennial on Saturday. Beginning with a parade at 930 a.m. Throughout the day there will be games, entertainment and food at the Centerville School. Also this weekend the 12th annual Western Rendezvous of Art show in Helena at the galleries of the Holter Museum of Art. Friday, Saturday and Sunday. Paintings and sculptures will be on display and for sale. Also this weekend the auditions for the center stage production of Anything Goes at 1.30 p.m. on Saturday in the College of Great Falls Theater. The musical is scheduled for October 26th through the 28th and November 2nd through the 4th.
