The events caught on a tape obtained by 5 Eyewitness News. Watch closely. Officers trying to subdue a man appear to kick the suspect while pinned on the ground. The struggle would continue. Watch again as the suspect is put in the car. A policeman slams the car door on his leg. The second time this week, a Minneapolis police officer is caught on tape, leading to an inquiry of police brutality. Good evening everyone. I'm Cindy Bercato. First, that tape showing an officer slapping a handcuffed man. And now tonight, more accusations of excessive force and a new video tape involving a kick to the head by another Minneapolis police officer. Kristen Steiner with the video you'll see only on 5. We took the video tape to Police Chief William McManus who late this afternoon turned it over to Internal Affairs to investigate. When the new chief came to town, he promised zero tolerance for officers who crossed the line. Question is, does this kick in the head you're about to see cross that line? The tape shows a suspect on the ground with three officers subduing him. Now watch as a fourth officer moves a bicycle and then appears to kick the suspect in the face. It's very disturbing. We showed the video to Michelle Gross of Communities Against Police Brutality. She says it's another example of Minneapolis police going too far. That's ugly. That's really ugly. The man on the ground is Jontez Watson. His mother and girlfriend say before the video started rolling, Watson got caught up in a shoving match with police outside the Quest nightclub. They were saying things to him and he was saying things back and then they started shoving and then he pushed the police officer off of him and he ran. After the kick, police wrestle with Watson to get him into the squad car, his friends urging to calm down. While officers struggle to put Watson in the squad car, he kicks at a cop. The officer slams the door, catching Watson's leg. Look out! We also showed the video to attorney Bob Bennett who has sued on behalf of many clients alleging police brutality in Minneapolis. Why would you do something like that? Bennett says it's not clear whether the kick is excessive force, but he says it clearly incited the crowd, putting other officers at risk. Why would you kick him even if you didn't intend to hurt him and provide a basis for all these other people to get mad at us? It's time to move, move! Police allege Watson hit an officer later that night at the jail. His trial on that charge starts next month. Watson's family says the court will determine his guilt or innocence, but they want the public to know how police arrested him. No one deserves to be kicked. Minneapolis police won't talk about this tape because it's now considered an active investigation. We tried to reach a number of independent experts to talk about police procedure. They did not return our calls. In the newsroom, Kristen Steiner, Five Eyewitness News. To reiterate, part of Kristen's report, the suspect you saw on the tape does have a police record, including a conviction for aggravated robbery. He's also facing trial for assaulting a police officer last June, and that's not all. He has a charge pending for taking a swing at a police officer just a couple of months ago. We now know that those hazmat crews did not find any explosive material inside a federal courtroom in St. Paul. They were called, along with federal marshals, about three this afternoon, to a courtroom for a drug trafficking case involving Hell's Angels. It happened here. A moist stain was found on a courtroom bench during the break. That was the reason for the concern. But tonight, fire officials say all the tests indicate it was nothing hazardous nor was it harmful. A 19-year-old now facing murder charges in connection to a deadly hit-and-run crash. Investigators say on Saturday night, Kyle Murphy was harassing his ex-girlfriend, and 17-year-old Timothy LaValle was trying to get him to leave. Witnesses say that Murphy intentionally hit LaValle with his car and then kept on going. I think he should go to prison for the rest of his life. He killed somebody's life. He took somebody's life. His life should get taken away. Whether it was on purpose or not, he did nothing to try and stop. He didn't slow down until he hit him. The friends of the teenager have set up a makeshift memorial. You can see it here at the crash site. A St. Cloud man accused of soliciting two teenage girls for sex. Police say that Michael Baker approached the 13-year-old's last night at a park on 15th Avenue and 4th Street North. The girls ran from him and called 911. Officers found and arrested Baker at the park scene. Tonight, he is facing felony charges of soliciting children to engage in sexual conduct. New tonight, hundreds of people mourning the future loss of mourning doves to hunters. Caring signs like Let the Doves Live, a large crowd packed the Capitol steps. Tomorrow marks the first mourning dove hunted more than 50 years in Minnesota. Protesters liken the doves to songbirds. We're not necessarily against all hunting or we're not necessarily all vegetarians or anything else. We're people of many different views on those issues. But we all believe that the mourning dove is not an appropriate bird to shoot. The Minnesota legislature disagreed and approved the hunting season last session. The season runs from September 1st through October 30th. More troops than the Minnesota National Guard activated for service now in Iraq. About 500 members of the 1st Battalion of the 151st Field Artillery in Montevideo will be heading to Iraq in January. They'll be overseas anywhere between 18 months to a couple of years. Many of them will leave September 17th for training at Fort Dix, New Jersey. This is like winning an Oscar. As if I would know. Speaking of acting, one of my movies was called True Lies. And that's what the Democrats should have called their convention. The Republicans getting off a prime time zinger with Arnold Schwarzenegger, the California governor revving up the delegates at the Republican National Convention. We have team coverage now on the political season in front of us. Craig Negrelli live in St. Paul with some potential voting problems we might have here in Minnesota. But let's start with Tom Hauser live in New York City. Tom? Cindy, as you could hear, Governor Arnold Schwarzenegger electrified this crowd here tonight at Madison Square Garden. It's clearly the loudest it's been since the convention began yesterday. He even had the crowd chanting USA, USA on a couple of occasions. He also recited lines from what seemed to be every Hollywood movie he ever made. We'll have more on Schwarzenegger in just a minute. But first, it was a Minnesotan who kicked the night off by calling it the roll call of states. George W. Bush has received more than the 1,255 votes required to secure the nomination of the Republican Party. Senator Norm Coleman is a co-chair of this convention and announced that Pennsylvania had put the president over the top for the nomination. But it was Arnold Schwarzenegger who stole the show. He rallied support for the president's economic policies and his leadership in the war on terror, support that was later backed up tonight by First Lady Laura Bush. We have won America and President Bush is defending it with all his heart and soul. That's what I admire most about the president. He is a man of perseverance. He is a man of inner strength. He is a leader who doesn't flinch, who doesn't waver, and does not back down. You can count on him, especially in a crisis. His friends don't change and neither do his values. He has boundless... And again, that was First Lady Laura Bush speaking just after Arnold Schwarzenegger. And as I mentioned, he was a tough act to follow tonight. Laura Bush was introduced by her two daughters and also by President Bush himself who appeared live via satellite. Back to Schwarzenegger, one other thing that he said tonight that got a huge response from the crowd. He said that anyone who is a pessimist about the economy right now is nothing but a girly man. That was a line that got him in some trouble in California recently, but the crowd here absolutely loved it. Live in New York at Madison Square Garden, Tom Hauser, 5 Eyewitness News. Well, before we leave the scene there entirely, we have to tell you that New York police arrested more than 100 protestors near the site of the fallen World Trade Center today. You are now all blocking the sidewalk. If you do not disperse, you will be placed under arrest. And police snapped plastic cuffs on the demonstrators as they tried to lead a march to the convention. Hanging chads, butterfly ballots, that was the problem. You'll remember that in the 2000 election. It prompted voting reforms ordered by the feds. But tonight, some people say that Minnesota's new system is bugged and in need of repair. Craig Nagrelli continues our team coverage. Greg? Cindy, two weeks from tonight, Minnesotans will go to the polls on primary night in September. About two months after that, it's the general election. But there is growing concern here at the Capitol that those elections will be bogged down by a boondoggle, that there will be long lines at the polling places and people wondering, where's my name? I mean, I'd like to know who the elected president is within a day or two of the election, and three months later after 10,000 lawyers have gone through all the cases. And that's why state Senator John Hottinger is concerned about this system. It is the state's new software designed to ease the process of voter identification and verification. But there are glitches. In four Minnesota counties where special elections have been held this summer using this new system, names have been left out, lists incomplete. The question, what's going to happen on primary and election day? We're just worried. We don't know whether the system can handle everyone being on the system at once. Will it crash? Who can forget the 2000 presidential debacle in Florida? As a result, the federal government approved new laws on how to manage state voter files. Over 40 states got exemptions this year. Minnesota did not. And now the race is on to get it fixed before it even functions. There's 7,000 Minnesotans serving overseas in the military. We do not have any verification from the Secretary of State's office that they'll be able to vote. At the Republican National Convention, Minnesota Secretary of State Mary Kiffmeyer moved to allay those fears. I'm absolutely confident that everything we need for the voters will be there and we're going to have a smooth election. Now some have suggested going back to the old system for this election. However, the Secretary of State's office is too far along with this new computer program to do that. The best advice, bring ID with you when you go to your polling place. Walter Mondale posed for pictures, shook some hands, and then took to the podium to talk about cutting the costs, the rising costs, of higher education. The band has been entertaining crowds for more than three decades and tonight they rocked at the grandstand. Tomorrow night, Cyndi Lauper takes the stage. At least it's a local man who apparently has been seen around town dressing as the man of steel. However, St. Paul police are putting an end to his escapades. They arrested him for disorderly conduct at the state fair in what turned out to be kind of a super showdown. Todd Baer live outside the state fairgrounds where he was witness to all of this. Todd? Well Cindy, this is Vendor Row just across the street from the state fair. You can see there are interesting things to do and see out here like this shoot the monkey event here. But no one garners quite as much attention as Superman from fairgoers. And now as it turns out, police. Truth, justice, and the American way will always prevail. Superman is back just days after St. Paul cops arrested him for disorderly conduct. The whole concept and principle of what Superman stands for is standing up for what's right. And that's just what John Phyllis says he's doing by returning to his bead outside the state fair. Selling five dollar pictures of himself yards from where police say he broke the law. It's Superman. Come on. Phyllis was arrested Friday after St. Paul police said he violated his peddler's permit by staying in one spot and not moving up and down snelling. Is there like bullies? One of the officers said, well, I don't like your tone of voice. Don't use that tone of voice with me. And I said, I'll use any tone of voice I want. This Superman has done this before. His arrest record dates back to 1993, mostly for disorderly conduct as it relates to his superhero act. For the most part, I'd say about 80 percent of the times I've had problems with the law, I've been completely innocent. Police say he will be arrested again if he doesn't keep moving as his license requires. For now, he is the talk of St. Paul and his battle for justice rolls on. Now, Superman, who usually stands somewhere in this area here, is taking the next couple of nights off. But as the crowds pick up later in the week, he assures me he will be back out here selling five dollar pictures of himself. And at that point, we may just get a sequel to all of this. Continuing our string of unusual stories, here on Friday night, 5 Eyewitness News introduced you to a new process that turned cremated remains into diamonds. Our story attracted a lot of attention across the Twin Cities, even got some attention nationwide. Today, a mother from Coon Rapids decided it would be a very good way to remember her son who died a year ago in March at the age of 36. But I could never think of anything other than a pin. So, and I thought of what else could I do? And nothing came to mind when I heard this story on TV. I thought, that's it. Again, turning cremated remains into diamonds. Parts of Virginia, ooh, they are just in a mess tonight, underwater, after Tropical Storm Gaston dumped up to 14 inches of rain. Five people are dead, one is missing. Water filled city streets in Richmond, an area still cleaning up from Hurricane Charlie. The governor wants a federal declaration of emergency to deal with the devastation there. Meanwhile, another threat churning over the Atlantic. The International Space Station took these images of Hurricane Francis as it makes its way toward the U.S. Dave, this is a Category 4 storm, is that correct? Right now it's a strong Category 4. It has winds up to 140 miles an hour and it could hit anywhere between, our report says, Florida and the Carolinas. Right. Is that still your prediction? Yeah, I think so. We're going to take a close look at this and show you the track that we expect it to take. Of course, that can change. It's still about three days away. Over the next 24 hours, we're going to watch it gradually turn, we believe. If that happens, then it will probably take it right up the coast. Right now, it appears though it could make landfall anywhere from South Florida all the way up to maybe Georgia or South Carolina. As you can see the time frame there, Thursday it will be going through the Turks and the Caicos. By Friday it should be in the southern Bahamas. Then by Saturday it could be making landfall somewhere in the southeast. Now, if it takes a little sharp return to the right, it may make a landfall later and that would be up more toward maybe North Carolina. But right now it does appear as though it will make landfall somewhere in the southeastern part of the United States. It's a very strong Category 4. Okay, wow. Meanwhile, we have some great weather here. It is gorgeous out there right now. Can't complain about that. No, we have a gorgeous night tonight. Thunderstorms have erupted in a couple of spots. Take a look at SkyMax 5 and you can see that there are a couple of them on the screen, but not many. Scattered through the east central part of Minnesota, right down through the central part of Chisago County, north of the metro. And there were a couple of stronger storms down in southern Minnesota as well. We'll take a little closer look at the activity that's just north of us. It was up around Cambridge just about an hour ago. And now it's tracking very slowly to the east, southeast and weakening as it's heading toward I-35 there. And you can see I'm going to give you the motion over the last three hours and watch those thundershowers gradually kind of pulse, get stronger and then weaken. And right now it's in one of its weaker stages. It's going right through the North Branch area, very close to North Branch and south of Harris there. That is about all that's left on the radar scope. We still may get an isolated thundershower here across the eastern part of our state and into western Wisconsin. But overall, it looks like conditions will settle down the rest of tonight. It's going to be a gorgeous night out there. Currently over eastern Minnesota, weathernet live stations. Take a look at Cottage Grove. 82 is the high. The current reading at 65 and many of the readings have slipped a bit. Not bad, though, for this time of the evening. Upper 60s and lower 70s. 64, though, in the afternoon, one of the cooler spots. The official reading out at the airport right now is at 70 degrees. The dew point 63. So the air is still a little sticky. We have an east wind at five miles per hour. The temperature pressure is steady up north in the 50s. 52 at Duluth. We are, of course, still at 70 here. 68 at Mankato. Showers and thundershowers that we had early in the day, those have pushed to our east and just a few isolated storms here in the eastern part of the state. I think overnight tonight most of that will push on to the east, giving us clearing skies, expect plenty of sunshine and gradually warming temps. This cool front is going to return back as a warm front. And as it does so, temperatures are going to warm up. And I mean really warm up. We could even approach 90, it looks like, by Thursday. Overnight tonight down to about 63 with northeast winds. Tomorrow then a very nice day. Lower dew points and a temperature of around 83 with northeast winds at five to 15. Then the winds start to switch around to the south again. And we're calling for 87 right now on Thursday. But the latest information says we may get closer to 90. And then showers and thunderstorms break out again late Friday into Saturday early. The rest of this Labor Day weekend, very nice. Right now it looks like mid to upper 70s for highs. 90 degrees, hit it just before Labor Day. So at least technically we can get it in. A sticky day, yeah. Right now this ball game is still tied at five in the 11th inning. It was a pretty good sight before the game. Joe Mueller was taking some batting practice even though his knee is still hurting. His swing is still a thing of beauty. He's still a few weeks away though from playing. The Vikings will be without their first and second spring running backs when they open the season against Dallas. But is Mike Tice worried? I made the mistake and asked him. He's got Mo Williams in the backfield. Plus Matt Burke is back. Mo started the first four games last year and averaged over 81 yards a game. We can run the ball when we want to run the ball. We showed that to you guys last week. All you Joe Schmitz out there that were worried about us not being able to run the ball. We'll run the ball when we want to run the ball. Moroney was the Big Ten freshman of the year and helped the Gophers set a conference record for total offense. But there can always be improvement from being a rookie. I respect a lot more for myself. Last year I was new on the scene so everything I did was great. You know what I'm saying? I made big plays. It was lovely. So they really didn't look at my mistakes because I was new to the game. But now they really expect more from me and I expect more from myself. The Gophers open against Toledo at the Dome Saturday night, 8 o'clock. The World Cup of Hockey comes to the XL Energy Center Thursday for hockey star fans worried about the NHL. Tonight they sold out 21,000 seats in Montreal for the USA against Canada. Joe Sackett of the Colorado Avalanche scored Canada's second power play goal of the night.
