You. Startling new information involving a rape allegation against the quarterback for Kansas State University who starred in the Fiesta Bowl. A man behind bars accused of killing two people. And I'm Kerry Lake first on Fox. He is accused of sexually assaulting a woman at a Paradise Valley resort. But tonight Fox News obtains the police report in the case against L. Roberson the Kansas State quarterback who played in this year's Fiesta Bowl. And it raises some new questions about whether he will even be charged now. Mark Martinez live in Fox News Central with the story and the new information. Well Kerry here is the police report it was just released today by Paradise Valley police. A lot of work went into finding out exactly what went on inside that hotel room last Thursday morning. But in the end police say it ends up being one person's word against another. The police report on the alleged sexual assault involving L. Roberson is 50 pages thick. Here in black and white a 22 year old woman who claims she was raped by the Kansas State quarterback tells police she thought she was having sex with someone else. The woman says she was drinking at the team's Paradise Valley hotel and had consensual sex twice with another member of the team earlier that morning and thought she was having sex with him not Roberson. The woman tells police when that football player left the hotel room he left the door cracked open. She says someone came back into the room got back into bed with her and had sex again just a few minutes later. But she tells police she didn't know that man was L. Roberson. In the report the alleged victim says when she realized who it was she began saying no wait wait no. Roberson tells a different story to police he insisted she knew it was him and she was a willing participant. He says he never heard her say no or wait. Now the alleged victim in this case also says that she used to tutor L. Roberson at Kansas State and that at one point she had wanted to date him but he was unavailable. It will now be up to county attorney Rick Romley to look through all of this information and decide whether there's enough information enough evidence here to press any charges against L. Roberson. Any idea Mark when that decision could be made by the county attorney? We expect it sometime this week probably tomorrow or Friday. Alright Mark Martinez live tonight. A guilty plea from a former high school teacher accused of having sex with a female student Grace Games pleading guilty to two counts of sexual conduct with a minor. She'll be sentenced next month this was Games in court last year. She taught English and coached the freshman girls basketball team at Tempe's Marcos Dinizia High School. She was fired after her arrest last March. Two arrests now in the case of a five year old girl who died with more than a hundred and seventy bruises on her body. Twenty year old Linda Verdugo has been arrested for child abuse. She's the mother. Next to her in court today her boyfriend Joshua Villalobos. He's now charged with the murder of that five year old girl. According to court records Villalobos admitted to police he punched, kicked and shook the little girl. The couple brought her dead body to the hospital over the weekend. Court records released today show the mother saw her boyfriend shake the girl in the past. He also admitted to Verdugo the mother that he squeezed the child's face causing the bruises. Those who know the mother though have a hard time believing this. It's pretty upsetting to think that the mother wouldn't report it but I can't imagine that from her not from what we know her here. She's too good of a person. We love her up here. The child's mother admitted to police that she should have left her boyfriend or called police. Two people found dead inside a Northwest Valley home and tonight police believe they have the man responsible behind bars and his brother is speaking out to Fox 10. Ramin Killeley joins us live with the story Ramin. And John just continues to be a tough night in this Peoria neighborhood for all the neighbors. Police tape still up outside the home of Victor Martinez. Down here if we can pan down this is the new addition. Some candles, some roses, other flowers. The remnants of kind of an impromptu memorial service for Mr. Martinez and Lupe Zavala. You remember that couple found dead inside their home last night wrapped in plastic in a bedroom closet most likely bludgeoned to death. Tonight police say they have the man who may have committed this crime but that man's brother says the police got the wrong guy. Faded memories of a Peoria couple flicker on the front porch. Victor Martinez and Lupe Zavala live on if only by the flame. He was not a violent person. Relatives of the man charged in their murder say police have the wrong guy. City man Ben Cota has been charged with two counts of first degree murder. Brother George stands up for the family. I honestly do not think he did it because he was not a violent person honestly. Regardless six months out of prison Ben Cota is back behind bars and candles light the front walk in Peoria. A gruesome scene inside no one knowing how to handle things on the outside. It surprised us all. We don't know what to do. And family says no way lest anybody think this is not an active scene. Police still on the scene here and police state still up. John police had taken this down earlier in the day. They put it back up and as for a motive they're looking right now at robbery but have not confirmed anything. And robbery because of some type of drug involvement? Ramin? Okay we've lost Ramin Kalili but you get the general idea he's live in the west valley tonight thanks Ramin. A big legal fight in court today as jury selection nears in the hit and run trial of former phoenix bishop Thomas O'Brien. The lead attorney for O'Brien asked for a delay in this trial because he feared the county attorney Rick Romley would file an obstruction of justice charge against him. We're talking about the attorney now. It all started when O'Brien's attorneys announced they purchased a car that was supposedly another car involved in a fatal accident that eventually led to the charges against the bishop. Prosecutors were angry when they didn't learn about that car right away. O'Brien's attorney said the situation would make could make the bishop ask himself a pretty tough question. Is Mr. Henze my lawyer going to be protecting my interest or in the way in which he proceeds in this case is he going to be protecting his own interest? The prosecutors have told O'Brien's attorney he would not face obstruction of justice charges so the motions hearing does continue tomorrow. One suspect two schools put into lockdown in Mesa from Sky Fox you can see the SWAT teams creeping toward the front door of the home. This is near Broadway and Val Vista inside a man wanted for a probation violation. That was enough to put two nearby schools into lockdown. Well I'm going to the school I want to go get them. After the bell rang the principal came on the microphone and said this is a real lockdown. You got the final act there that's the suspect coming out of the home a short time later they had fired a bunch of tear gas in there and finally flushed him out. He was taken to the hospital for observation. I'm sure you can imagine this happening to you. You go to get money at the ATM machine and there's somebody pretty close behind you. That's what happened to this guy but the guy behind him was a robber. Watches the man at the ATM notices him he sees he's much larger he's crowding in on him then he hits the victim after he gets the money out of the machine punches him right on the side of the head. The suspect the robber takes off the victim chases after him. This robbery happened on New Year's Eve at the CMI Bank near 19th Avenue in Dunlap. A wet and wild wake up call for some residents of a Phoenix trailer park. Take a look at this a water main bust no bigger than the size of your fist and it caused all of this. This was near 31st Avenue in Van Buren shooting water 30 feet into the air and raining gravel and rocks down on that trailer park smashing out windows flooding one of the units. A police officer happened to be just feet away when that line exploded. It sounded like something off a wall. It really did it just kind of a loud booming sound. Traffic and water in the neighborhood was shut down for about three hours while crews worked to repair that line. One day in Iraq 35 American soldiers are wounded today during a mortar attack on their base. The military says insurgents fired six rounds into a living area at the base. Also in Iraq freedom is coming for 500 Iraqi detainees. The people rounded up in raids like this one they will be released from detention camps. Many of the soon to be released are suspected low level associates of insurgents. That's Fox quick picks a plane forced to make an emergency landing when the gear wouldn't come down. This is in Boone County Indiana outside of Indianapolis and you see the pilot put it down did a great job. He was able to walk away from that kind of rough landing without a scratch. One man is rushed to the hospital after a Pennsylvania house is leveled by a natural gas explosion. People in the area actually called in to complain of an odor and a few hours later the victim's home blew up. People were evacuated until crews could stop that gasoline. Orlando the front of a truck sheared off in a deadly accident. The driver rear ended another truck triggering an explosion. One person died in the accident. The Florida turnpike was shut down for four hours. And roads were slick in San Francisco but this wasn't snow or ice it was grease. A truck leaking cooking oil and kitchen grease leaked it all over Highway 101. Police had to shut down the road for several hours to clean things up. Fortunately nobody was hurt in that mess. He has coached his teams into the playoffs eight times. Can lightning strike nine times? Dennis Green can he turn around the Arizona Cardinals? Jude LaCava live with more information on the Big Reds new coach. Well John his track record is impressive as an NFL head coach in 1998. He coached the Vikings to a 15-1 record. He resurrected the careers of Randall Cunningham, Dante Culpepper an instant success. Dennis Green named today as the new head coach of the Arizona Cardinals. His record in Minnesota 101 wins just 70 losses. Four division titles. Head coach at Northwestern at Stanford. Fabulous resume and a guy who gets it done pretty quick. This was his visit last week in his interview process with the Cardinals. He'll make the official press conference news conference coming up on Friday for the official announcement but this is what he has in mind coming to Arizona. And now comes the winning. What comes first the chicken or the eggs? You got to win before you get to the new stadium. And so one of the objectives that I talked to him about again was bringing the fans back. Creating the excitement, coming in and having a program that the fans want to come out and watch the Arizona Cardinals play and watch their players play well. We will see. What's interesting about Green is he has had a knack of being able to work with a variety of quarterbacks. Veterans making a comeback, young guys, rookies. That's his track record, his numbers. He's a Bill Walsh disciple. A lot of good things. Will he have an opportunity to put his stamp on the football operations in terms of track draft, free agent signings and just orchestration of the organization. While moderates say Mr. Bush's plan falls short, many conservatives call the president's plan dangerous and unworkable. Our laws should allow willing workers to enter our country and fill jobs that Americans are not filling. The president calls for a broad new temporary visa program, a program that would allow foreign workers to legally take jobs here in the U.S. three years at a time. All undocumented workers in the U.S. would be eligible, like this man who wants to be called Raul. He likes the idea. He owns a business with 12 employees in California. I'm just like McDonald's. I pay my people. I got a payroll. I pay taxes. Mexican President Vicente Fox says the plan will give Hispanics now working illegally in the United States the same rights as their legal coworkers. Once temporary worker status is granted, immigrants could travel freely between the U.S. and their home country. 17 years ago I came to this country and I don't see my parents, my mom, my father, and you know it's kind of hard. I think his proposal recognizes what's going on, is that there's 8 to 14 million illegal aliens, people without status here in the U.S. The president says this is not amnesty. I oppose amnesty, placing undocumented workers on the automatic path to citizenship. Granting amnesty encourages the violation of our laws and perpetuates illegal immigration. Still immigrant groups and liberal-minded critics say the president needs to go a step further. We'd really like to see a path to permanent residency and a path to citizenship for all immigrants who choose to do so. But some on the right say the president's plan goes too far. There are millions of Americans who are unemployed. Our schools are overcrowded. We don't have adequate housing now. What's the thinking behind a proposal that is clearly so contrary to virtually every major U.S. domestic priority? In response to the critics, the president says one of the reasons America became a great power was because of the values brought here by immigrants. Under the president's plan, Arizona would certainly feel the impact with a large number of immigrants here. But many of them are here illegally. Fox 10 talked to one man whose life could potentially be changed. Masabi Pera is a father of two. He works in the valley as a roofing assistant. Now, Pera says Bush's plan would change his life 100 percent. It would also give him a chance at obtaining citizenship. With this new proposal, it will cause me to come out of the shadows and to live more freely. Not only have I been waiting for it. I have been fighting for it. Many people thought the president would model his immigration reform plan after a bill filed by Senator John McCain and other Arizona lawmakers. However, he chose more of the principles from a Texas senator's proposal. An unusual outfit, the fighting chicken. This is a crook during a robbery. We'll tell you how this all ended coming up later. The actor says he turned down the chance to appear in The Godfather Part 3 because he wasn't offered enough money. Duvall started as Tom Hagen, the half brother to Michael Corleone, played by Al Pacino. Duvall says that Pacino is offered three to four times as much money as him and he says that was an offer. An unsolved murder caused by an apparent case of road rage. The killer is still on the loose tonight. And tonight we hear the last words from the dying man calling 911 for help. Mac Rue was murdered nearly five months ago. He left behind a young son, three years old. And police are releasing a disturbing 911 tape to try to get some information on whoever killed him. Troy Hayden is live in Fox News Central with some of that tape tonight. Troy, this is hard to hear. It is. Not easy to listen to at all, Carrie. In fact, this young man is literally dying while he's on the phone. But police are hoping somebody who hears this might remember something about that day back in August. 911, what is your emergency? I've been shot. Where are you? I've been shot. Where are you? This is Rue trying to get help in the final moments of his life. The 23-year-old was shot in a road rage incident while driving on Interstate 10 last August. Even though he seems eerily calm, he knows he's not going to make it. Please help me. OK, stay on the line. I'm fading, sir. What type of vehicle are you in? I'm dead. I'm dying, man. All the time this is going on, Rue's three-year-old son, Mac Jr., was in the back of the car. He wasn't hurt. It's been nearly five months now since Rue was killed. Police still have no solid leads. Investigators hope hearing this promising life slip away might make somebody call in with information on his killer. Sir, can you hear me? This happened back on August 22. Happened on I-17 South, then went out to I-10 West. That's where he died out there. The suspects, all police know, two Hispanic men inside a small white car. If anybody has any information about that day, they're asked to call Phoenix police. The reward is up to $11,000. In tonight's Valley Scan, investigators are testing a woman for alcohol after she plowed her Lexus into two cars yesterday. The accident happened near Guadalupe in Price. One victim, Suzanne Borcher, had to be pulled from her burning car by some good Samaritans. She's in fair condition tonight. Well, you saw the incredible video yesterday of the man, or of the accident here on the 101 near McKellips. We now know the name of the person in that truck. 41-year-old David Dalton died before the crash. Medical examiners believe Dalton suffered some kind of medical condition. Arizona sending some heartfelt support overseas to our fighting men and women. This is happening from the post office at 49th Street in Van Buren. The National Guard sending off banners to the troops in Iraq, each signed by the Veterans Medical Center. A parking ticket dispute turns into a lawsuit and the whole thing is caught on tape. Take a look at this. A woman's struggling here with a New York City sheriff's deputy. You can see that he swings at her. He eventually throws her to the ground. What led up to this? Well, it started when the woman asked the man if she could just pay $239 in cash or whatever to get her car before they hauled it away and towed it off for parking tickets. She was originally charged with resisting arrest and assaulting an officer, but those charges were dropped. So now she's suing the sheriff's department. NASA's rover on Mars hasn't done much roving yet. Scientists say Spirit's first move likely won't come for another week now. These are 3D pictures of the red planet. Now the reason Rover isn't cruising yet, scientists are plotting its course. There are some pretty nifty sized obstacles out there. There are also some pretty interesting scientific targets. We're learning a lot about them with the pan cam. Now mission managers are still having some trouble clearing one of the deflated landing airbags to get it out of the way. Once Spirit does move, its first stop will be a crater that may tell scientists if there was ever water and possibly life on the red planet. A famous 85 year old evangelist is on the man after taking a fall. Reverend Billy Graham is recovering in a Florida hospital after breaking his left hip. This was Graham before the accident. He was actually on his way for a checkup when he fell in his hotel room. Graham's spokesperson says he's in good spirits and is expected to make a full recovery. News organizations want to see the records in the Michael Jackson molestation case. News organizations have asked a judge in Santa Barbara County to release those records. The records were initially sealed for 45 days back on November 17th. That was the day before authorities searched the Neverland Ranch. The defense wants those papers to remain sealed. Well we thought we'd give you a Fox follow up on Joey Buttafugo. He hasn't been in the news for a while but he pleads innocent to charges stemming from an alleged auto insurance scam. Buttafugo made headlines more than a decade ago when his 17 year old girlfriend Amy Fisher shot his wife in the face. He was arrested last month however as part of a sting operation that led to charges against ten other owners and employees of California auto repair shops. A judge ordered him to report back to court next month. That's when a judge will determine if there's enough evidence here to go to trial. One robber's disguise can only be described as foul. Dressed in a bright yellow chicken suit, you've got to give him points for originality. You can see the gunman holding up a grocery store in Ohio. The chicken stole cash from the store safe and then flew the coop before the cops arrived. Is it over yet? No, not yet I guess when it comes to the flu. Have we seen the worst yet though? Arizona is one of 42 states still battling the flu bug. Doctors say the flu has tapered off in five states so far. However in other states the flu has not yet reached its peak. The Megabucks lottery controversy in Ohio takes another strange turn. It's wacky. Maybe more aptly describe it. Stephanie Sandoval live in Fox News Central. What is going on with this woman? She's got a criminal past. That's what's going on. And even though the money has already been awarded to another woman, the woman who claims she lost the winning ticket is holding her ground. And as I said she has a criminal past. Alicia Battle is certainly making a name for herself. The self-proclaimed owner of the winning 162 million dollar lottery ticket who says she lost the ticket in this parking lot. We're asking the court hold on. Don't do anything. Rather give us the opportunity to see the evidence and to test the evidence. But lottery officials say they've already reviewed the so-called evidence and say Rebecca Jemison is the winner and she has the winning ticket and receipt to prove it. Battle's attorney says it doesn't add up though because his client knows things that only the winner would know. How can a person know the date and the time and the place and the machine? Battle's case is being questioned even more now that news of her criminal past has come to light. These are mugshots dating back to 1992 for convictions of misuse of a credit card, criminal trespassing and assault. Whatever happened in the past, you know, they dig up dirt. They don't know what's behind that. Lottery officials say it's of little concern now. Lottery tickets are a bearer instrument. It's like having cash in your hand. If you lose the cash, you're most likely not getting it back. You need to present us a winning ticket. Now when asked about those past convictions, Battle simply said, yes, I was charged but I was not convicted. Police reports, however, show a different story. They show she was in fact convicted. Hold on for just one second here. She says she lost the ticket, right? Right. Having trouble keeping a straight face on this. The other woman, there was no evidence that she found the winning ticket, right? She bought the ticket. No, and what's interesting, that's correct, John, but what's interesting in this, the woman who turned in the winning ticket, it was a crisp, pristine ticket. The woman who claimed she lost it said she lost it outside. It might have fallen in the snow and she had people looking in the snow. Again, that winning ticket, perfectly pristine, crisp winning lottery ticket. She took home $92 million after taxes. Yeah, I'm thinking of Dr. Evil. Right. Thanks, Steph. There's a rumor going around that the gasoline pipeline, the Kinder Morgan pipeline has broken again. People are already flocking the gas station, but we talked to the governor's office and they have an explanation for all this. You don't want to miss it at 10 o'clock. Also, some people hope this isn't a sign of things to come. This is all about at 10 and one woman is going to great lengths to look for love. The Arizona Cardinals begin a new era hiring former Vikings head coach Dennis Green. And just a couple of minutes ago, I got off the phone with coach Green San Diego and listen to this. He makes no hesitation. Dennis Green expects success immediately for the Arizona Cardinals. We want to be a playoff team the first year. We really do. I think to do that. I mean, the playoffs this year and the AFC West and that's the St. Louis Rams and the Seattle Seahawks. You know, in the national football league over the last few years, different teams have been able to get in the playoffs and other teams have had a more difficult time repeating. And so we hope to get in there and take the place of someone who can't repeat. Now, coach Green has won everywhere. His coach making the playoffs eight times in his 10 year run at Minnesota. Dennis Green brings to Arizona a history of winning. In Minnesota, he made the playoffs eight of his 10 seasons. I've always built programs. I mean, if you look at my background, you know, I was at Northwest and I was at Stanford, I was at the Minnesota Vikings. And there's something very exciting about coming together with the new staff, coming together, working with people, coming together with players and then watching that momentum. Green has a strong resume. He's part of the legendary Bill Walsh coaching tree. What I'm accustomed to doing, I'm accustomed to helping the team feel good about themselves and playing hard and going all out and winning close ball games. That's what I'm accustomed to. That's what I was accustomed to when I went into Minnesota for my days being one of the many, many, many, many assistant coaches who thought they could be head coaches on Bill Walsh's staff. The new coach has a strong track record with quarterbacks and the card's current QB is impressed with his hiring. I played against Coach Green a couple of times when I was in Cincinnati and his offenses were very explosive. Moved the ball, ran the ball well. Defense was very competitive and that's the key, I think, of winning championship games. You have to have a competitive defense to win championship games. Dennis Green is not short on confidence.
