Now at I-Masters. This is Box 26 News at 9. News that works for you. A shootout outside a Texas City bar. He wouldn't give himself up. He just stayed in there. Three police officers injured, the gunman dead. Good evening, I'm Mike Barajas. And I'm Melissa Wilson. Thanks for joining us tonight. The shooting happened this afternoon at Don's Barn Grill in Texas City. That's where Fox 26's Michelle Cusses is working on the story tonight. Michelle? Mike and Melissa, witnesses say, describe the scene as a war zone just by the amount of gunfire they said they heard. Now investigators, including Texas Rangers and state troopers, are still here some seven hours after this incident happened, looking for evidence. It is easy to spot the evidence. Something went terribly wrong here. Shattered glass, bullet casings, and a semi-automatic pistol littered the street in front of Don's Barn Grill. He wouldn't give himself up. He just stayed in there. Mary Simmons is the girlfriend of the bar's owner, Don Mensch. She is talking about the suspect killed by police. She considered him a friend. That was his favorite place to come to, and if he wanted to end his life, that was the place to do it in. Police say the suspect entered the bar holding the owner and patron's hostage. He later let everyone go. The lone gunman then fired one shot inside the bar. As the officer approached the building, tried to make entry into the building, he came out shooting, shooting at the officer's officer's return fire. Three officers from the injury team were shot in the process. They are veteran Sergeant Dick Young, who suffered the most serious wounds, Officer David Fairchild, and Detective Joe Stanton, who was treated and released. The officers who shot the suspect, who I understand is now deceased, appear to have been acting in their lawful authority in defense of themselves. Anytime you have any shootings like this, it's going to be emotional on all the officers involved. Friends say the suspect moved back to Texas City from Georgia a week ago. He did have some final words for the bar owner. He said, I'm sorry I have to do this to your brother, and my boyfriend said, well, you do what you have to do. Now police still have not released the name of the suspect pending notification of his family. Friends say that his wife is still behind in Georgia. Police also say the suspect has a record, but they are not releasing that either. Live in Texas City, Michelle Casas, Fox 26 News. Thanks Michelle. Other officers are coming together tonight to help the police officers who were shot. They are giving blood at the University of Texas Medical Branch in Galveston. Sergeant Dick Young is in serious condition. Officer David Fairchild is in good condition. And Detective Joe Stanton was treated and released. A 10-year-old Channelview boy faces charges for the shooting death of a friend. The boy is in custody and charged with criminally negligent homicide and the shooting death of Joshua Lee Jones, who was also 10. The two boys were playing with a shotgun yesterday when it went off, hitting Jones in the neck. He died later at the hospital. The Harris County Sheriff's Department says no adults were home when the shooting happened. A pilot parachutes from his plane just seconds before it crashes to the ground in Montgomery County. Trey Arman of Baton Rouge, Louisiana, was flying in the Gulf Coast Regional Aerobatic Competition today when his plane's rudder cable apparently broke loose. Arman, who is also a skydiver, parachuted out and landed safely. No one was hurt. The plane crashed into a field between Conroe and Willis. A Houston doctor is behind bars for prescribing controlled substances with no medical purposes. Point one, five, nine. There you go. There you go. 57-year-old Richard Mosby was arrested three months ago in a case that's still pending. Authorities say immediately after he made bond, another tip was received that he was writing prescriptions for people who didn't need them. An undercover investigation was launched involving undercover cops making appointments to see the doctor. On three different occasions, on each and every occasion, in less than a minute, he once again prescribed controlled substance codeine, bicaridin, which is a painkiller, in less than a minute. Each of the undercover officers involved were examined by other doctors both before and after visiting Dr. Mosby, and none needed prescribed medicine. A new program between St. Luke's Hospital and the city of Houston helps save a man's life. Fifty-year-old Michael McCaukey was riding a metro bus when he suffered a cardiac arrest last month. An automated external defibrillator installed in the lobby of the Public Works Building helped save his life. There are now 49 defibrillators installed in various Houston City buildings. President Bush approves funding for limited stem cell research, but not everyone is happy about that decision. John King reports. The White House effort to manage the political fallout began before daybreak. The morning news shows the president came under fire from both the right and left. In the White House view, proof his call for federal funding of limited embryonic stem cell research was a true compromise. One of the things you learn as president is that you're not able to make all people happy all the time. Mr. Bush said the administration had identified some 60 existing stem cell lines and that he would support federally funded research using those. But he opposes using tax dollars to gain new stem cells by destroying leftover fertility clinic embryos. Aides say the president made his decision on moral and ethical grounds and that he admonished aides who talked politics during his deliberations. But the Bush team closely monitored the political fallout, and of most concern was sharp criticism from conservative activists. We must not continue this slide into Nazism by deliberately creating life to kill it. This is immoral and it must be stopped. And the Catholic Church. The president's decision unfortunately allows the allotment of federal funding, the money we pay in our taxes, for something that many of us feel is morally wrong. It opens the door to experimentation on human beings. But other key conservative leaders were more positive. The National Right to Life Committee said it was delighted the president opposed destroying more embryos to harvest new stem cells. Focus on the family's James Dobson, whose radio show reaches up to 10 million people a week, said Mr. Bush deserves praise. And while House Majority Whip Tom DeLay said he was disappointed with the decision, he also said he believed Mr. Bush made it from his heart, not from politics or polls. Some Democratic leaders will push for broader federal research, using leftover fertility clinic embryos that Mr. Bush wants kept off limits. But the administration voiced confidence the president had made a persuasive case in his first nationally televised address to the American people. Thank you for listening. Fox 26's Ford Atkinson got reaction from patients and researchers. A pump is working a medical wonder for Jamie Smith at MD Anderson Cancer Center. Stem cells from the 19-year-old's blood are being removed. After they take the stem cells, they'll freeze them. Eventually, the stem cells will be returned to her body to help the lymphoma patient recover from cell-bruising effects of chemotherapy. No surprise, Jamie is a big supporter of embryonic stem cell research. I'd go for it, because, you know, cures are better than throwing away fetuses, like they said. Any thinking person, I believe, can see both sides of this issue. The vice president of research administration at MD Anderson says he wants federal funding of embryonic stem cell research, but respects President Bush's decision to limit it. I think it's going to be used to understand the genesis of cancer and what goes wrong in cancer. Stem cell research may have a more dramatic impact on the fight against heart disease. That's what they're finding here at Baylor College of Medicine. So what are you going to do here? Robert Schwartz supervisors research on embryonic stem cells, not from humans, from mice. And we're able to convert a large number of these embryonic stem cells into beating cardiac myocytes or muscle cells. Schwartz predicts applying research on mice to humans is just a few years off. As for the president's decision... I believe it's a very inspired, thoughtful presentation by President Bush. A presentation, Schwartz says, could one day lead to human embryonic stem cell research at Baylor. Working for you at the Texas Medical Center, Ford Atkinson, Fox, 26 News. Health officials warn young children, the elderly, and people with medical conditions about the dangerous Houston heat. Dozens of Harris County residents have died due to the heat-related illnesses over the past two years. Those with heart and respiratory problems are more susceptible to heat exhaustion. Health officials urge you to stay out of direct sunlight, drink plenty of water, and wear light-colored clothing. There may soon be a little relief from all that heat. Let's hope so. You know, we are going to have a very hot and steamy weekend starting with tonight, very muggy outside. But check out what's going on nationally. We've got a cold front, an August cold front pushing into the eastern part of the country. A little bit of that cooler air trying to get to Houston. But it looks like the biggest impact will be a change in humidity. We're talking about around Monday. The jet stream today, way over the northern tier of states, is going to change in shape. And that means we'll have a northwesterly flow aloft, and that's going to help push the tail end of that front through the Houston area. That means some lower humidity, maybe some lower temperatures. In the Fox Health Beach, students must get all their shots before starting school in the Houston Independent School District. But this year, there is one exception. There's a national shortage of the 10-year booster shot for tetanus endothelium. That shot is usually for students at age 14. But the Texas Department of Health is giving students until next August to get that immunization. Protecting your skin from the sun's damaging rays should be a year-round habit. As Dr. Zoe Ndryer tells us, it will prevent skin cancer later in life. Every summer when he was younger, Gene Scott used to spend a lot of time in the hot sun with his shirt off. Go to the beach, get sunburned. It was just part of it. We'd get sunburned two or three times a year. In fact, most of the time, Gene suffered second-degree burns. He never thought those days would come back to haunt him. But after an annual trip to the dermatologist, he found out he had skin cancer. And it's on my back, about a half an inch circle. And he biopsied it and found out that it was a squamous cell. Squamous cell carcinoma is just one of three types of skin cancers. The other two are basal cell carcinoma and malignant melanoma, which is the most dangerous and responsible for 80 percent of deaths from skin cancer. The biggest risk for malignant melanoma is intermittent, serious exposures, burns. Anyone, for example, who has had three or more blistering sunburns in childhood is at higher risk for developing a melanoma. Melanoma will often have uneven borders, be dark or irregular in color, and have a diameter larger than a pencil eraser. Anytime you have a growth that is changing in color, size, shape, bleeding, itching, any change at all is a warning sign. Try to get up as high as you can. Surviving skin cancer opened Gene's eyes. He now applies sunscreen with an SPF of at least 15 before heading out in the sun. He also puts on a hat, a long-sleeved white shirt, and sunglasses. Since most of us won't wear long-sleeved shirts at the pool or the beach, it's important to reapply sunscreen every two hours. Also, stay out of the sun between 10 a.m. and 4 p.m. I think there's a lack of awareness on the part of the public about the potentially serious nature of skin cancer. Every hour in the United States, somebody dies of skin cancer. Skin cancer, however, does have a 99 percent cure rate if it's caught early. Box 26's Patty Shea reports, as area children head back to school, coaches and trainers also hit the books for some life lessons. The contact, the running, the average two-hour practice, combine all those together and you can imagine the toll physical activities take on young bodies. In the playbook today for coaches and trainers with the Spring Branch Independent School District, a conference focusing on prevention and treatment of sports injuries, sponsored by the Red Cross. Anytime that you're a parent of an athlete, especially with the hot weather we're having around, you need to make sure that the student themselves takes precautions, has adequate physicals before they come and do any athletic activity and get acclimated to the heat. Sometimes we're lulled into a false sense of security from season to season because maybe last year went well, but each year is a new year and we have new kids coming in in new situations. Parents will be happy to know that more and more school districts are bringing into the lineup full-time athletic trainers. In football, because it is a collision sport, we have a lot of injuries that occur from minor abrasions and contusions and sprains to the more serious types of injuries. Of course, in this time of the year we're mostly concerned with the heat problems that we're going to be seeing. The first thing we do is laps around the track. Kenneth Thurman, who's learning everything from first aid to CPR, isn't talking about an athletic team per se. He's with the band. Let's go out on the asphalt that's been cooked for a couple of hours in the heat at about five o'clock in the heat of the day. Let's put on a 40-pound drum and let's run around while playing it. And that's the way band works. We're musicians from the waist up, but we're athletes from the waist down. I think one of the best things a parent can do is get involved with their child. And if they have concerns like that, they should get to know what is going on in the program and know what the coaching staff is doing for those types of things. The key to dealing with the oppressive heat is conditioning and water breaks. But the trainers tell me some athletes are still getting bad advice and not taking advantage of hydrating your body before you feel thirsty. Prevention is the key whether you're dealing with heat exhaustion or any other injuries. And the goal is healthy athletes. Working for you in West Houston, Patty Shay, Fox 26 News. Now, Fox 26 Weather with Chief Meteorologist Cecilia Sinclair. It's the last weekend before heading back to school for a lot of folks. So a good weekend to head down to Galveston Island. This is a live shot of the seawall. Water temperature perfect for a dip, 87 degrees. And it's a good thing we have a way to cool off because it's been hot today. A hot day, blue skies out there, sunshine, a few towering cumulus clouds, a few thunderstorms over eastern and southeastern Harris County. We saw about an inch of rain in La Porte, about three quarters of an inch down in the Friendswood area. This is what it looked like 12 hours ago, not much going on, but again another round of sea breeze, afternoon showers and thunderstorms, you could see those as they moved in. Also some showers and thunderstorms moving south through Arkansas. Some of those have been severe. High temperatures today, many locations, 100 degrees or higher, and in southeast Texas. With a high temperature of 96 and the humidity factored in, it felt like it was well over 100 degrees for most of the afternoon. Now the record for today is 104, so we didn't have a record, but we did beat the normal high for this state, which is 93, and our low this morning was 74. Temperatures outside right now, middle 80s, factor in the humidity, feels like 93. That humidity is 72 percent, winds right now are out of the south and the pressure's rising. Keeping an eye on the tropics, we are moving toward the statistically most active time of the year. That's the end of August, early September. There is a tropical wave here in the eastern Atlantic, moving into an area more favorable for development, so we'll continue to keep a very, very close eye on that. Well, it's been another stormy day across parts of the Rockies, around Colorado and also Arizona, there's been some flash flooding. The big story, though, some storms which move through the New York City and Boston metropolitan areas. Severe storms, knocking down tree limbs and power lines. The weather there has improved considerably. They also had some stormy weather for locations to the west of there. That rain is going to be pushing off to the east and south here the next day or so, courtesy of some cold fronts, some cooler, some drier air behind these fronts, but ahead of it, very humid and also very hot. Now, the front itself won't quite make it here for a couple of days, so we're going to be dealing with a very steamy weekend. As we look ahead to Sunday, slightly greater chance for thunderstorms, and that's because as the front moves closer to us, that destabilizes the atmosphere a little bit more. Then Monday, that's the day we think will get the tail end of some of that lower humidity. Don't expect a big dip in temperatures. Maybe a couple degrees cooler in the mornings, but actually perhaps a little bit hotter in the afternoons because dry air does get hotter than moist air. Low temperatures tonight across the northern interior states in the 50s. That's the place to be if you want to cool off tomorrow's highs around the nation, looking like summertime and a little bit nicer for folks in the northeast who have been sweltering for the last several days. Allergy levels for Saturday, low on the grass pollen, medium for mold spores, and for you boaters, seas running a little bit high, 3 to 4 feet, but otherwise looking pretty good in the bays with a slight chop. So for tonight, low temperature 74 Bush Airport, 76 downtown, 83 on Galveston Island. Tomorrow, hotter day still than it was today, 97 for a high Bush Airport, 20% chance for afternoon showers and thunderstorms, 30% for Sunday, and then Monday, Tuesday, a little less humidity. Hooray! Sexual harassment is a hot topic this summer because more people are wearing less to beat the heat. As Fox's Molly Falconer reports, employers are having a tough time coming up with guidelines for summer dress codes. As the heat rises, so does concern at many companies that sexual harassment claims do too. All that summer wear at work, short skirts, short sleeves, plus tighter sexual harassment policies can all add up to trouble. Someone who's wearing bare midriffs to the workplace, they're going to get comments. And those kind of comments about their body and about their attire can lead to problems with sexual harassment, yes. Other experts say casual clothing leads to a casual attitude inside the office that can add to the tension. And some employment lawyers report it's not just the women who get comments on dressing up in skimpier clothing. Men have said sometimes they feel like they're getting set up. They're afraid that if they notice, if they look, that there will be a charge made against them. Some labor lawyers say it's logical claims go up during the summer, but even so, many say people should be allowed to wear whatever they want. I think that's really stretching it to suggest that because it's warmer weather and because men and women may show a little extra flesh during the summer months, that that would be inviting sexual harassment. At the same time, employers find themselves at a legal bind. Often they don't have the codes dictating what kind of casual attire is allowed. It's ridiculous to say that because there's a little bit of cleavage or there's a short skirt, that that either explains it or excuses it. Companies becoming increasingly concerned that lightening up on the dress code is making their caseload all the heavier. It may not be a matter of taste. It may be a matter of the bottom line. Space shuttle Discovery blasted off into space just before a line of thunderstorms rolled in. Eric Phillips reports on the mission to the International Space Station. Three, two, one. Booster ignition and liftoff of Discovery. In the ninth inning, Mother Nature cooperated, allowing the liftoff of STS-105. Earlier in the day, the seven astronauts and cosmonauts strapped into the shuttle Discovery on launch pad 39A in preparation for liftoff. The delayed launch has not detracted from the mission. We've prepared a long time. I'm a real lucky guy. I've got actually three great crews to work with. The Discovery crew will fly the shuttle to and from the International Space Station. The Expedition 3 crew is about to make space their home for the next several months, taking the place of Expedition 2. We need to keep pushing the human race to expand beyond the current boundaries that we have. I wanted to talk a little bit about an experiment that's been a big part of my life this week. Expedition 2 has been in space for five months. They're looking forward to the small things. The sounds of birds or insects or different things like that, conversations in the background, those are the kind of things that you miss a little bit. The mission will also involve attaching the Leonardo module to the station using the shuttle's robotic arm. Leonardo acts as a cargo van carrying supplies like clothing, water and experiments. Two spacewalks highlight the mission, and once the crews have been swapped out, Discovery will detach and circle the International Space Station before returning to Earth. So Expedition 3 is on their way to the International Space Station, and Expedition 2 will soon be on their way back home. At the Kennedy Space Center, I'm Eric Phillips. This time, a three-team are involving the Knicks and Mavericks. We told you last night the Rockets were working on this deal, and here's how it breaks down. The Rockets will get Glen Rice from the Knicks and the rights to Mavericks. Second round pick Kyle Hill out of Eastern Illinois. Houston also renounces the rights of Sean Colson, Devin Gray, and Matt Bullard. They're all free to go. The Knicks get Shandon Anderson and Dallas' Howard Isley, and the Mavs acquire Muggsy Bogues from New York. Sources tell us Anderson has signed a six-year deal worth $42 million. Rice has three years left on his $27.6 million deal, and Houston will pay $20.8 of that. Rudy T. and C.D. Talk. You know, we know him well. He's a dangerous offensive player, a guy who I think just fits with the young penetrating guys we have, and I have a real good feeling about getting him. As much film as we've looked at on Glen Rice, I'll say this, he's a great scorer, and he's a much better repounder and a much better defender than he's been given credit for. We thought it made sense for everybody, and so we went along with it. I think it's going to, and I hope this is one of the deals that works out for everybody, because that's when it's a good trade. Only two seasons in a Rockets uniform, and it's quickly over. The nature of the business side of sport. Mark Berman spoke with Shandon tonight and got his point of view. Now that he's no longer a Rockets, Anderson acknowledges his style of play on offense never meshed with the Houston scheme. You just get into situations sometimes where you don't fit with a certain team, and I think that was just the case. I guess I feel I've got a better feel with New York, where they play aggressive defensively. The twos and threes a lot of the time are pushing up a lot, so when I look at it, I think it's a good fit for myself. In 164 games with the Rockets, Anderson averaged 10.5 points, 4.5 assists a game. I think I just got lost in the shuffle more than anything. I think any time you bring 10 players, new players to one team, and you try to get a coach to try to implement every player's game, it's kind of hard. I think he was just put in a tough situation, and I was just the guy who was just left out there in the cold. Anderson leaves Houston with no hard feelings. It's just like a relationship. I would love to say I would marry the first female I ever dated in my life, but that just didn't happen. That's all it is.
