Good evening. Hundreds turn out to commemorate the young life of a Madera teen who was brutally murdered. Also, the governor announces a new plan to bring jobs and tourists back to the Golden State and a disappointing day for supporters of gay marriage in San Francisco. We've got those stories and a lot more on the 10 o'clock news starting right now. You're watching KMPH Fox 26 and now the Valley's only primetime newscast. This is the KMPH 10 o'clock news. It certainly is not the final chapter in the brutal murder case of a North Valley teenage girl but a memorial service this evening sought to provide at least some sense of closure to friends and family of that of Rose Johnston. And hundreds of Madera residents turned out to pay their respects to the murdered girl. Steve Yocum was at the services and joins us now with our top story. Steve? John and Jadine, Rose Johnston probably didn't know how many friends she had but now just a little over a week after the girl's charred body was discovered in the trunk of her burned out car, a standing room only crowd came to a memorial service in Madera. People saying they wanted the chance to say goodbye. As the time for the services neared, more and more people arrived. Mourners waiting in line to go inside the Grace Chapel and remember the brief life of 19 year old Rose Johnston. Well today we're just trying to celebrate her life. We're really just trying to remember her as she was in the 19 years that she was with us. This woman told us she was present at the very beginning of the murdered girl's life. She was like a little sister. Her mother and my mother were best friends her whole life. I was there when Rosie was born and her birthday is the day after mine so it was a birthday gift to me really. Other friends hadn't seen Rose for a while and the shock of her death coupled with seeing so many old acquaintances in one place was overwhelming for some. It's been kind of really emotional for everybody because personally I didn't see Rose before she died. Last time I saw her was when I graduated and my friends had called me and told me she died and it hit me harder than I thought it would. Isaac Prado was a former classmate. She was just a really sweet person. We didn't go out very many times but there was a time we went to a winter formal and it was just having a fun time dancing with her. She was always smiling. I knew her at a college class as well and every day she always came in with a smile and a sweet attitude. And almost everyone gathered here said Rose Johnston would have been the last person they'd ever expect to die such a violent death. It's just a total shock because like I said she's a sweet person with a beautiful soul. There was no casket at that service today because police say that although they're certain of who was in the trunk of that burnt car, Rose's body has yet to be officially identified by special forensic techniques. So the remains still haven't been released to the family. John and Jaydeen back to you. There is other news tonight. Governor Arnold Schwarzenegger campaigned on two major issues last year fixing California's budget crisis and of course the promise of bringing more jobs to this golden state. Well earlier today the governor introduced a job team in charge with making good on that promise. Darryl Nail is live in our newsroom tonight with more on that story. Darryl. John Schwarzenegger says he's going to quote make the state boom again by creating a commission to create more jobs. Sounds good but here in the valley where double digit unemployment is the norm it may prove difficult. Sean Wheatley carefully reads each job lead in his email. The recently unemployed cad drassman moved to Fresno to look for work but he fears he might have to eventually leave the state. It's like a state you really want to stay at and it's like putting pressure on you to look elsewhere in other states. And for good reason since 2001 close to 150,000 technical jobs have disappeared from California alone. If we get all of the jobs back is really not the question. The question is how can we create a positive atmosphere here that we get some of the jobs back and also create new businesses. Schwarzenegger says he's turning to a privately funded commission to help him. The panel will offer suggestions to the governor on issues ranging from foreign trade, unemployment insurance and environmental regulation. And they will be in charge of really bringing jobs back and bringing our economy back. But will the job promotion team bring jobs to the valley? In Fresno County double digit unemployment is the norm. Although this has come down recently in January the rate was still a whopping 15.4 percent. Yeah if it increases the number of employers for example who use the center that's here it will help the unemployment problem in Fresno County. Blake Consol is the director of the Fresno County Workforce Investment Board. Although he has high hopes for Schwarzenegger's commission he says Fresno County's biggest challenge is not a shortage of jobs rather a shortage of qualified employees. Leading companies in the world that are here in the valley focused on that they cannot find qualified workers. Sean Wheatley says Schwarzenegger's program might help him. If it does it will take time. The commission will be headed by investor F. Warren Hellman and RAND Corporation Chairman Ron Olson. Now some credits say that could create a conflict of interest and it's not clear yet how the private group will be organized or funded. Live in the newsroom Darrell Nail, 10 o'clock news. Those at the Centers for Disease Control say California will be the epicenter for West Nile virus this year. The CDC says the disease is spreading fast and that we'll see a sharp increase in the number of West Nile cases this year. Since the discovery of West Nile in the northeast in 1999 the virus has spread at an alarming rate posing a major health threat for humans, horses, birds and other animals. For humans it's created a public health concern. West Nile virus is transmitted by mosquitoes. Currently there is no vaccination for humans. The Central Valley Health Policy Institute has issued its second report in eight years on health in the San Joaquin Valley and one South Valley fares worse than the rest. We get the story from Tom Wells in our Visalia Bureau. Of health in the heartland the crisis continues presented their findings at a meeting in Hanford. Kings County government officials and health professionals learned that not much had changed for the better in nearly a decade. The death rate for diabetes Kings County ranks 58 out of 58 counties. Similarly in teen pregnancy Kings County is 57 out of 58 counties. One of the causes cited by the report was a population heavily dependent on government health programs. We have larger numbers of people who live in poverty. Our education level tends to be lower. And all of those factors tend to influence access to health care. The survey also notes that 10 percent of Kings County residents speak little English or none at all. Now that means that there is a big impact as you try and access providers or even just have a discussion with your doctor. So language barriers are a big issue that really have to be addressed if we're to improve the overall health in the county. And there are about 4,000 children in Kings County who are not covered by any type of health insurance. If we could get those kids into a system of coverage that would improve their access and that's something that we know exists. The report recommends increasing the number of health providers, educating people about available health programs and using medical interpreters to help non-English speaking families. Dieringer has a special hope for the next survey. To come back in another several years and show how conditions have drastically improved in the county, how Kings County is at the top of the state instead of at the bottom of the state. In Visalia, Tom Wells, KMVH News. Well sunny days and the stagnant warm weather also means trees are filling the valley air with pollen. Big time. The high pollen count is increasing the number of pollen induced asthma attacks and hay fever. Some valley residents say it's harder to breathe this time of year and pollen levels are expected to stay pretty high through the rest of the week. In the meantime, sweet, juicy summer strawberries, that's the promise from farmers who say they couldn't ask for better weather for their crops. In fact, farmers say the summer berries are growing faster than usual and their sugar content is increasing as well. Now that means that you can expect plump, red, sweet strawberries in the grocery stores in the coming months. So when you start thinking about that 4th of July barbecue, I mean already, I mean this is only what, we're only in March, you'll want to make sure that strawberry shortcake is certainly on the menu for dessert. I love giant, sweet strawberries. Well there's going to be a lot of them it sounds like. It's going to be a good year, a good summer for that. And they're good for you too. Yeah they are, very good. I love them. You think you like them too, right? I love them, I love those strawberries. They're great here in the valley and they're all over the place in abundance and we're so lucky to have those wonderful strawberries in our backyard. And the weather is going to cooperate because they're going to get bigger and redder as we move into the weekend because we've got a nice forecast in store for you today. As a matter of fact, today we were 15 degrees above normal, we hit a high of 80 in Fresno. Let's take a look and see what the situation was. Unfortunately, like we mentioned earlier, John was talking about the pollen, very high unfortunately, and the mold also very high. Of course with this sunny weather, beautiful flowers sprouting up, bulbs everywhere. Let's take a look and see what kind of weather we're going to have tomorrow. When you wake up at 8 o'clock, a little bit of patchy fog. We had some this morning in and around the Kings County area around Hanford. Visibility had dropped down to about a quarter of a mile. And then tomorrow more, tomorrow at noon, mostly sunny and 73 and 78. By 5 o'clock in the afternoon, as far as the air quality, it is going to be unhealthful in Fresno, in Madera, and in Tulare counties and moderate in the rest of the valley. The California Supreme Court today ordered an immediate halt to same sex marriages until a full legal review can be held early this summer. We get more in this report. 245, the sign went up. No more same sex marriages in San Francisco City Hall. Still a lot of activity here as disappointed couples were consoled by friends as they tried to hide their disappointment. Jean Rizzo and Polly Cooper just missed their three o'clock wedding date. We were about to go in to do the paperwork at a quarter of three, which is what you do, and somebody got a cell phone call out amongst our friends and there was just a look of horror on their face. And I said, oh my God, the Supreme Court's ruling, rush, run. And we ran to the clerk's office hoping maybe we'd get there before they figured it out and they were putting up a sign. City attorney Dennis Herrera says the city will abide by the Supreme Court's order to cease gay marriages until the city can make its case in late May or early June to the California Supreme Court. If the city is victorious, couples who missed their weddings today say they will be back. This really feels like just the beginning. I feel like the wind is blowing in your favor. The wind is blowing our way, yes. And hours after the state Supreme Court ordered the marriages to stop altogether, San Francisco City attorney sued the state asking for a determination on the constitutionality of same-sex marriages. Dennis Herrera says that he wants the courts to make an unequivocal declaration that banning same-sex marriages is in fact unconstitutional. And Massachusetts lawmakers have adjourned their constitutional convention until March 29th after approving three preliminary votes that would ban gay marriage and create civil unions. The amendment still needs to pass one more critical vote. If that approval happens, the measure would then be put on hold until the 2005-2006 legislative session. At that time, lawmakers would have to again pass the identical amendment before it could be sent to voters in November of 2006. Still ahead on the 10 o'clock news, the Valley Museum pays tribute to the heroes of 9-11. Also a bombing takes the lives of nearly 200 people. After the break, we'll tell you who's taking responsibility for the deadly blast. A British reporter says Al-Qaeda is taking responsibility for today's deadly Madrid train bombings. The editor of the London Al-Quds newspaper is telling Fox News that he has received a letter from the terrorist organization which claims they were behind the explosions in Spain today. Newspaper officials say the correspondence, which arrived this afternoon, does look authentic. At least 190 people were killed and 1,200 injured when 10 bombs exploded in Madrid trains and stations at the height of the morning rush hour. We'll back here. Stunning and emotional images served as the centerpiece for a reception earlier tonight at the Fresno Arc Museum. They honored local law enforcement and firefighters. The chilling photographs were taken just after the 9-11 attacks that took place. And while they bring back disturbing memories, museum officials hope the exhibit serves as a positive reminder of sacrifice and survival. I think with the amount of work that people did and the bonding that it did, the united feeling that you had after the event and the fact that the human spirit really did prevail, that it is what keeps us going every day. The 9-11 exhibit will remain at the Fresno Arc Museum through this coming weekend. Officials say that law enforcement, firefighters and their families will receive free admission. Republicans were expecting to find a contrite John Kerry today after he was caught on an open microphone calling the GOP a crooked and lying group yesterday. However, when asked about the remarks on Capitol Hill, the Democratic presidential candidate stood by his allegations. Brian Wilson reports. If Republicans thought John Kerry owed them an apology, it was not forthcoming. I have no intention whatsoever of apologizing. It was a defiant Kerry refusing to disavow rather incendiary comments made Wednesday following a union appearance in Chicago. Kerry walked over to some union workers, apparently forgetting that he was wearing a lapel mic. He was partially blocked from camera view when a union member urged him to quote, tell it like it is. But you can clearly hear his response. We're going to keep pounding, let me tell you. We're just beginning to fight here. These guys are, these guys are the most crooked, you know, lying group I've ever seen. Republican leaders took umbrage and were quick to jump on the comments. If you ask me, he's getting off on the wrong foot in this campaign. To call people liars and crooks, and particularly thinking that you were off mic, just shows you who the real person is. What was Kerry trying to say? Today, he loosely referenced the tough campaign tactics used against Senator John McCain in South Carolina when it appeared McCain's 2000 presidential bid might be gaining ground. And Kerry alleged that Republicans questioned the patriotism of former Georgia Senator Max Cleland during the last election. Then candidate Kerry added, There is a Republican attack squad that specializes in trying to destroy people and be negative. Exactly who makes up the Republican attack squad, who are the crooks and liars, all questions left unanswered as Kerry bolted from the photo op. Though the presumptive nominee did not name names, his campaign spokesman David Wade did. He pointed to J. Thomas Birch, a Vietnam vet who was critical of John McCain's stance on Veterans Affairs issues during the 2000 campaign. Birch now works as a lawyer at the Department of Veterans Affairs. Wade also said that Karl Rove, the president's top political advisor, quote, has the reputation of engaging in political dirty tricks. John Kerry and former opponent John Edwards were conspiring today at a Washington hotel. It had to do with money, really. Edwards introducing Kerry to some of his financial backers. In Washington, Brian Wilson, Fox News. Last month, Harry J. Pappas, the president and CEO of this television station, testified at the decency hearings in Washington, D.C. Well, earlier today, lawmakers on Capitol Hill worked with unusual speed to approve a measure that now gives the FCC, the Federal Communications Commission, even greater power to fine broadcasters who break the decency rules. The penalty could reach as high as $500,000. Congressman George Radonovitch gave his thoughts on the measure. Met for a certain amount of time. So I think it's putting the networks on notice that I think the public, which owns these airwaves, these are airwaves that are in the public domain, need to be aware that there is a line that they can cross when it comes to decency and what they broadcast to the American public. The FCC will also hold a hearing on whether a broadcaster's license should be revoked if the rules are in fact broken. The U.S. Senate is also considering a similar bill. The Environmental Protection Agency is studying the chemicals released into the air when a bag of microwave popcorn is popped or opened. Exposure to those vapors has been linked to a rare lung disease contracted by factory workers in four states. The chemical suspected of causing the illnesses is called diacetyl, but health officials insist people who microwave popcorn and eat it at home are not in danger. Lucy Postens is a canine nutritionist who created a line of low carb, high protein dog foods. The honest kitchen foods are meant to resemble the meat based diet eaten by wolves. They provide an alternative to regular dog foods which are loaded with carbs. You read the ingredient panel, you'll see things like corn, corn gluten meal, corn flour, corn starch mentioned several times in the ingredient list. When you add up all those different corn components, corn then becomes the number one ingredient in the product. In the South Valley tonight a man is dead and a child is in the hospital after a car goes into a canal. Police say that a black compact hatchback was apparently speeding on Page Avenue in Tulare when the driver suddenly lost control near road 96. The car rolled several times ejecting both occupants before plunging into a canal. The male driver sustaining fatal injuries. No names being released but the seven year old male passenger is expected to survive. For businesses entering into transactions with Fresno City government the process is just about to get a little more regulated. At a City Hall news conference today District 5 Councilman Mike Dages said he wants to create new rules separating businesses which might be bidding on municipal contracts from the council members who will eventually vote on the awarding of those contracts. Remembering their presentation by bidders are always one sided and slanted to encourage the council member to vote their way. In my opinion each proposal must be judged on its own merits and not on the merits of political influence. Dages brought the proposal for the ordinance before the council on Tuesday and received a 6 to 1 in favor vote to proceed with drafting the ordinance. He says he expects to receive the same vote when the ordinance comes up for a vote into law at a later council meeting. Well the 11,000 students in the Merced City School District are about to see changes at their schools starting this coming summer. While the students are gone construction at the districts of schools will begin. That's because the passage of Proposition 55 last week brought in matching dollars from the state of California. It will help with the district's local bond measure as that passed in November. In all though the district is slated to receive about 30 million dollars to accomplish a number of projects including building two new elementary schools to modernizing classrooms and expanding school libraries and multi-purpose rooms. Good news out of the Chaffee Zoo tonight. Things are looking up for its tall new addition. The baby giraffe continues to make progress. Today he tried to nurse for the first time. Our cameras were there to catch him nuzzling up to his mother. As you can see after a little help getting up he is walking and able to walk around on his own. Curators say the baby's not out of the woods yet though but they're encouraged by his progress. Mostly we just have to go in the barn with him and his mom and just work really good. Keep him walking, keep him exercising all of his joints and legs so they can develop the way they're supposed to. And we're trying to get his head tucked up underneath mom where he's comfortable because if it's not his idea he doesn't want to do it. And work on trying to get him in there starting to nurse. Families flock to the zoo today trying to get a glimpse of the baby giraffe. Curators tell us attendance is way up this week thanks to the great weather and of course the new baby. The giraffe doesn't have a name just yet. The zoo is concentrating on getting him healthy first. Then workers will figure out what to call him. He's got to make it. He's got the entire city of Fresno pulling for him. Yes. He's got to pull through. The news has gotten a little better every day so that's great. Isn't he cute Danny? Very very cute. Before we even hit the semi-final round, both Fresno State basketball teams are out of it. A horribly frustrating season comes to an end for the men's team tonight against Boise State in quarterfinal action. Shontay Leggans turns out this is his last game as a Bulldog. He does his thing. Hits the runner in the lane. Then when Leggans buries the three ball, Fresno State is up seven to four. That would be their biggest lead of the game. Boise goes on a 20 to five run to take control. Brian DeFerris working it in the paint. He had 10. Former Fresno High star Aaron Haynes comes home and has a solid game. 14 points. Haynes actually twists his ankle on this basket, but he'd return. Marcus West brings the Bulldogs to within four on this three ball. He led the team with 16, but then they'd go scoreless for the next six minutes. Not Boise. They scored at will. Well, there is just one Valley high school team left in the state basketball playoffs and the Washington Union boys team is not it. The Panthers get blown out at Santa Margarita in the division three Southern California semis, 65-45. Memorial season is also over. The Panthers lose at Verbum day by two, 55-53. In girls action, Corcoran loses a heartbreaker to Marlboro of LA, 47-46. While Central Valley Christian, their girls team, is the only team left. The Cavs knock off Santa Fe Christian. They move on to the Southern California finals Saturday. It's hard to not look ahead to the top ranked UCLA Bruins Sunday afternoon, but the Bulldogs softball team has five games still between now and then as the Clovis Auto Row Classic starts up tonight with the 15th ranked Bulldogs taking on San Diego State. Scoreless in the second with the Aztecs break through on an unearned run. Shasta Lewis makes the catch. Bree Boyer tags from second. Lewis throws it away and Boyer scores. That was the only run of the game. Southern was her usual dominant self on the mat allowing just three hits while striking out five, but Corey Janelli was even better. The recognition was a complete surprise to Angel Arellano on her 10th birthday. An official with the Praise Report magazine stopped by Angel's home tonight to present her with balloons and the very first copy of the publication featuring the little girl's picture on the cover. The magazine focuses on good news, community and helping people. There's no question why Angel's picture was chosen for the cover. Her letter to the Fresno Bee on behalf of the Chaffee Zoo has spurred a flurry of donations and fundraisers, totaling more than a quarter of a million dollars. Angel says the zoo is a very important part of the community. It's a once in a lifetime thing to see tigers and elephants and giraffes and stuff. But not a lot of people in Fresno get to see that. If the zoo closes down, then what are they going to see? The zoo needs, of course, a total of about $3 million in repairs to keep its accreditation. We're shocked and troubled by it, too. And lately, it's getting worse. Network programmers seem determined to keep pushing the envelope at all times of the day, even when there are substantial numbers of children watching. Broadcast television traditionally has been the one medium that you could rely on as a safe haven for family viewing. We, as local broadcasters, are proud to have been entrusted with that duty. Federal law makes local broadcasters responsible for all material that passes through their facilities. For that reason, Congress also gave us the right to reject or preempt network programming that the broadcaster in its own discretion believes would be objectionable to the tastes and mores of the local community. It may surprise you, then, to know that the broadcast networks, through onerous affiliation agreements and other network business practices, have virtually stripped away their local affiliates congressionally mandated right to preview and reject objectionable content. Rejecting or preempting network programming can result in the loss of network affiliation by the local station. This would have severe adverse effects on the station's finances and therefore on the station's ability to serve the viewing public. If you are as concerned about the filth on television as we are, and would like to see indecency and profanity taken off television, please call your United States Senators. Tell them to support the Broadcast Decency Enforcement Act, which was just passed by the House of Representatives. This bill would increase the fines that could be assessed against the networks or any broadcasters who transmit profane or indecent material over the public airwaves. And while you're at it, please also ask our two Senators for these provisions. First, to restore local affiliates' right to reject indecent content before it gets to your living room by assuring that local affiliates have the right to preview programs. And second, to make sure that the fine goes to the content originator if, of course, the local affiliate doesn't have the ability to preview and reject the program. Please call Senator Dianne Feinstein and Senator Barbara Boxer at their local offices today. This is still a democracy.
