There are a few details tonight surrounding Governor Arnold Schwarzenegger's new state budget proposal except for one constant theme, no higher taxes. Good evening and thanks for joining us tonight. I'm Mike Hart. The budget plan will be announced tomorrow morning at 11 o'clock. Even with the 15 billion dollar bond measure on the March ballot a projected deficit of 14 billion still remains. Assembly Minority Leader Kevin McCarthy spent the evening talking California politics with students at Cal State Bakersfield discussing the budget and other related topics. Schwarzenegger aides have hinted that the governor will cut at least 4 billion in spending. McCarthy also pointed out the agreement reached with educators that will save another 2 billion dollars. McCarthy echoed the governor's pledge to cut waste fraud and mismanagement that he says has plagued Sacramento for the last five years. Now as for the proposed VLF backfill funds that were promised to local governments. McCarthy says Assembly Republicans tried to solve the problem last year but were blocked by the Democrats. Allow when the Republicans brought up a Democrat bill our Republican bill to solve it. We didn't care who got the credit we just wanted it solved. They wouldn't even let the bill come up. The daughter of our supervisor even abstained on the vote not allowing a Democrat vote to even be debated. McCarthy says there will be a lot of things people won't like with the budget but it's a start to bring back quote accountability. Governor Schwarzenegger has cut a deal with education groups as I mentioned that will allow him to save the state money, increase student spending and set the stage for school salary increases. The state schools are owed 4 billion dollars but Schwarzenegger is splitting the difference in this deal. Under the plan community colleges will also receive at least 200 million dollars in new revenue next year. I want all children to have what I had when I grew up which is a great foundation. I had great schools when I grew up. Great after school programs, great teachers, wonderful education, good mentors and outstanding coaches. That's what gave me the foundation to be successful in life. But any deals between the governor and schools are still subject to approval by the state legislature. Schwarzenegger whose budget plan is due out tomorrow said he will use the 2 billion dollars in savings to support other needs. Well a three state manhunt for a suspected killer is over and the three girls he kidnapped are safe. Police say the fugitive murdered four people in Georgia including his infant son. He is the father of two of the abducted girls, the third is his former stepdaughter. ABC's Steve Osansami reports. The director of the Georgia Bureau of Investigation was more than pleased to announce that the manhunt was over and the three missing girls were safe. We're here to announce that Jones is in custody. He has been shot. The Amber Alert paid off. 31 year old Jerry William Jones who is said to have promised to kill the girls was spotted by a motorist who called police. The state patrol from their position could see the three kids in the vehicle. Authorities chasing the Red Ford Explorer say he lost control of the vehicle near the Georgia Tennessee border. Jones spun out with the Explorer and struck the telephone pole. Jones is now hospitalized with a gunshot wound. Police say it was a failed suicide attempt. The youngest child was in the back seat covered with blood. Jones apparently had shot himself. The three children, 10 year old Brittany, 4 year old Brandy and 3 year old Tammy were uninjured. Two of the girls are his children, the other a stepchild. Jones is already suspected of murdering three in-laws and his own 10 month old child at their home an hour north of Atlanta. Police learned of the killings from Jones' ex-wife who was away in Oregon. Neighbors say he was upset she had a boyfriend. He's now being treated at a Chattanooga hospital where he remains in police custody. Steve Olsonsami, ABC News, Atlanta. Meantime the judge proceeding over Scott Peterson's murder trial agrees he cannot get a fair trial in his hometown. The judge ordered the trial be moved out of Stanislaus County. The trial scheduled to start January 26th but that's now likely to be delayed. LA, San Francisco and Orange County are all being mentioned as possible sites for the trial. The Harper family murders have been called the most heinous crime in Bakersfield history. That's according to Police Chief Eric Matlock whose department has still not wrapped up the homicide investigation now six months old. Matlock though says he's satisfied with his detective's progress, one that he predicts will be diligent and thorough despite taking place in a national spotlight. July 8th of last year investigators are called to the scene of a gruesome discovery. Three generations of the Harper family found dead. Police Chief Eric Matlock says the murder case was essentially cold when investigators arrived with no smoking gun. So we've had to recreate the crime scene and it's taken us from the west coast to the east coast which has really protracted the investigation and it involves a lot of different agencies contacting a lot of people, potential witnesses, and we have just volumes of reports. Matlock says evidence collected at the scene was analyzed at the BPD's and DA's crime labs along with the FBI. 23 News has learned that the DA's crime lab did firearm testing and DNA analysis. What exactly was tested is unknown. The FBI is handling trace evidence like clothes, fibers or hair. Matlock did say the Bureau is giving the Harper case a certain priority but they're at the mercy of their caseload. There's certain evidence that we've gathered and that we're analyzing right now and that's one of the reasons why the investigation is taking the time that it is. Is that evidence pointing towards any specific person? It may be. The only potential suspect, Vincent Brothers, has never been ruled out by police. Matlock would not say whether the evidence points to Brothers or any other possible suspects but he did say when the case is turned over to the DA's office in the near future there will be no doubt. Because of the nature of this crime, we want to make sure that we do all the things that we need to do so that if and when this case is prosecuted there will be no question. Now Matlock says they're still waiting for final test results and other unspecified information before wrapping up the investigation. When asked if there's an arrest pending based on the information collected up to this point, he says that was premature until they sit down with the DA's office and review the information. Well the Harper family's home remains empty as family and neighbors have taken over the weekly chores. Relatives of the Harpers continue their hope that the killer will be brought to justice. At Hillcrest Cemetery, Ernestine, Joni, Baby Marshall, Marcus and Lindsay Harper lay in their final resting place. The killer or killers are still on the loose. Ernestine's son, Eddie Harper, spoke with 23 News this afternoon from Winter Haven, Florida on this somber anniversary. Of course a day doesn't go by without us remembering and thinking about our loved ones and what happened to them and the tragedy and how it has really changed our lives. We would have wished that it would have been concluded and somewhat apprehended the day it happened or within weeks. But we have confidence in the police department that they are not rushing. Harper says he looks forward to the day eventually when his family will be reunited again. No suspects have been named in the first murder of the year. Now the victim's family is asking for your help. 21 year old Marcus Harlston was shot and killed last Friday night in the 600 block at East 3rd Street. He reportedly was headed to the neighborhood store. Police still have no leads in this case. That's why Harlston's family is asking neighbors to come together and keep an eye on the neighborhood and report what they know to police. If you have any information about the shooting, you're being asked to call the BPD or secret witness at 322-4040. A mountain lion was shot by authorities tonight after two bicyclists were attacked in an Orange County wilderness park. Now officials say the body of a man found dead near the scene of the attack may be the big cat's third victim. Now in the first incident, two women were riding mountain bikes in the Cleveland National Forest around 4 o'clock this afternoon. Eyewitnesses say the two women were riding down the trail when a fully grown cat attacked one of the women. We were just riding down Cactus and I was probably 20 feet behind Ann and this mountain lion jumped on her back. Started dragging her so I grabbed her leg and he dragged us down probably, I don't know, maybe 100 yards down into the brush. And I just kept screaming. Meantime, authorities are awaiting the results of an autopsy to determine if the body of a man found nearby was also the victim of a mountain lion attack. More than $250,000 worth of methamphetamines is off the street tonight thanks to the Kern County Sheriff's Department. Yesterday, the department's Special Enforcement Division arrested Thomas Ojeda Jr. and Gabriel Angalu, both of Delano, who charged them with selling and distributing the drug in the Wasco, Delano and McFarland areas. The undercover operation netted a total of five pounds of meth. The man responsible for a wild Bakersfield police chase in August is back behind bars tonight. Today, a Superior Court judge sentenced Humberto Benavidez to 17 years in prison. On August 28th, Benavidez stole a police car which led to a wild chase through Southwest Bakersfield. At one point, he drove his car into another police car. When he finally fled the scene, he hid it in the attic of a stranger's house for two hours, creating a SWAT standoff. Benavidez received a stiffer penalty than most because he already has a criminal record. It was a beautiful day in the South Valley. Meteorologist Doug Iverson is back now from vacation. Doctors have since replaced the tube with a softer one. Kevin Fritz, Zach's father, hopes his son will be back home tomorrow. It was the scene of an intense child molestation investigation, and now entertainer Michael Jackson says he can no longer live at his Neverland Ranch. So, is Neverland for sale? ABC's Sid Garcia investigates. There's no for sale sign out in front. It isn't officially on the market, but rumors abound. Bob Jennings is a local realtor with Coldwell Banker. He says this 2500 acre ranch in the Santa Ynez Valley can go for tens of millions of dollars. Well, you add on the celebrity of the property and the uniqueness. So the courts here normally would be dark on that day. The deputy sheriffs, however, are not court employees, so they're available. We had a greater availability of security personnel then for furlough days, so having it on a furlough day worked better for us. This is Sid Garcia reporting.
