It was a little bad that we had to clear up about a warrant. And uh... Judge, you can ask this lawyer. As soon as Corano says the word warrant, which implies prior bad acts, Zeno makes a second application for a mistrial. I think that there's evidence that the people intentionally brought this information before the jury and an intentional ignoring the court's order. And I'm moving for a mistrial with prejudice. If granted, a mistrial with prejudice would mean Davis would go free and could not be tried again. If granted without prejudice, Davis would face a new trial with a new jury. We were only about 15 minutes away from resting. And this was possibly the last witness on the people's case. And basically all the detectives were testifying to was the circumstances surrounding the arrest. And I didn't feel that we were in violation of any pre-trial rulings of the court. In order to grant a mistrial with prejudice, the judge would have to agree that the prosecution deliberately ignored his pre-trial rulings. I grant a pre-trial with prejudice. And is there application to have it with prejudice? That's denied. Please, may I? Please, may I continue? The judge also denies the defense's request to withdraw the application for mistrial, which would have allowed the trial to continue with the same jury. This is really outrageous that my client should be forced into a mistrial that he does not want. He should be forced into going to trial with another jury so that the district attorney who purposefully caused this mistrial, who intentionally, you know, he'd like this court to think he's just stupid. And maybe he is just stupid. And if he is that stupid, he doesn't, well that's just too bad. He doesn't belong trying felony cases if he's as stupid as he's claiming that he is. But you know what? I don't think he is that stupid. I think he knew exactly what he was doing. I don't think it was a mistake. And believe me, I've gone over that. You know, I mean I went through a stage of I wish I could just cut my tongue out. You know, I mean I went through that. Because I knew I was winning the case too. Yes, you can never tell what a jury is going to do, but I would have bet a lot of money that they were going to acquit in that case. I'm asking that he be released in his own recoginance. Thank you. Judge, that's over to people's object. Well I think about it now after everything. I probably would have said, you know, maybe not guilty. Because everything was just based upon what Mr. Eugene Morgan was saying. Everything was just so cloudy with what he was doing and saying on the stand. There was no way that I was going to say guilty after that man left the stand that day. How a jury would have voted in this case is uncertain, but what is certain is that the system can be manipulated, sometimes at the expense of justice. The prosecution in this case held Arthur Davis in jail and made plea offers based in part on his prior contact with the system, although his record was clean. And now the defense is appealing the mistrial ruling, knowing it could take years to resolve the issues.
