But first, for over two years Michael Jackson's been trying to live down those horrible allegations of child abuse. He probably thought he'd done that with the release of his new album and recent TV interview. But as Star Jones reports, there are accusations that continue to linger against Jackson. These from former employees who say they were fired because they knew too much. Two years ago, the eyes of the world focused on a 13-year-old boy who accused Michael Jackson of molesting him. Jackson vehemently denied any wrongdoing. Don't treat me like a criminal because I am innocent. Now Michael Jackson is trying to sculpt a new image for himself. The release of his latest CD, History, marks the next big step in the King of Pop's efforts to put the ugly specter of the child molestation allegations behind him forever. I could never harm a child or anyone. It's not in my heart. It's not who I am. When we get to court in front of a jury, we'll be able to prove that Michael Jackson is in fact a child molester. But Ted Matthews says the issue is about to heat up all over again. He's the attorney for five men who used to be security guards for Michael Jackson. The guards have filed a lawsuit claiming they were wrongfully fired from their jobs, in part because some of them say they were witnesses to Michael Jackson having what they call questionable relations with young boys. Don Stark worked for Michael Jackson for over five years. For a grown man of my age, I think Michael or 36 to this day, and to hang out to spend the better part of the evening with a young boy in his presence alone, that is questionable. That is inappropriate. Although the guards filed their lawsuit against Jackson nearly two years ago, their day in court is just now approaching. With one legal issue still pending, the trial could begin by the end of the summer. Bad news for superstar Michael, who wants his fans to forget about the child molestation accusations. One of the linchpins of the security guards case involves Michael Jackson allegedly telephoning orders to have a photo of a young boy destroyed. Leroy Thomas says he took the phone call. He told me to open the door. I did. He asked me to go inside, which I did. And he asked me to get a picture, which was in the bathroom. And what kind of picture? It was a Polaroid. It was of a kid, a young kid. How was the young kid dressed? He wasn't dressed. He was nude. He was nude. How old was the child in your opinion? I would have to say pretty young. I'm sure he's not over 15, he's less. You're saying Michael Jackson asked you specifically to go up into a bathroom, get a Polaroid snapshot of a nude, pubescent boy, and do what with it? And destroy it. What did you do? I did a Xerox. This along with similar claims of questionable behavior is the foundation of the lawsuit by the guards. But the issue is what the guards actually saw. Fred did you ever see Michael Jackson exhibiting inappropriate behavior to a child? No. Don did you ever witness Michael Jackson exhibiting inappropriate behavior with a child? No, not personally, no. But attorney Ted Matthews claims he holds a wild card. We have another guard in this case who actually saw touching. We have another staff member who saw touching an inappropriate dress. We requested interviews with both of these witnesses and our requests were denied. Michael Jackson has always denied any wrongdoing with any children. And in his initial response to this lawsuit, he reiterated his position. Jackson's attorney in the case is O.J. Simpson Dream Team member, Carl Douglas. Oh, in America, anyone has the right to file a lawsuit. The difficulty will come and they're trying to prove it. All that remains now before there is another public airing of molestation allegations is a legal decision. When the security guards were fired, they signed a waiver saying they would never sue Michael Jackson or his companies. But the guards now claim these waivers are invalid because they were signed under duress. Why did you sign the document? My bills were due and I didn't have any money and I needed my money. And were you told, Fred, if you don't sign this paper, you don't get a check? That's correct. So now the fate of the lawsuit and the prospect of another smearing of Michael Jackson's image lies in the hands of a California judge. These days, Michael says he's the victim. His wallet took a hit to end the lawsuit his 13 year old accuser brought against him. It has been widely reported that Jackson paid a whopping 15 million dollars to settle with the boy out of court. Recently, Jackson has said he settled to stop the matter from being in the press every day. We got together again with my advisors and they advised me to resolve the case. For the record, there have never been any criminal charges filed against Jackson. But that fact doesn't deter Ted Matthews from predicting victory for his clients. He says Michael Jackson should have been prosecuted. If it were anybody other than Michael Jackson, they would have been arrested and thrown in jail the day after the child's allegations came out. Michael Jackson has tried hard to put this child molestation issue behind him. But it just doesn't seem to go away. It must be enough to make the superstar scream. Now a judge is expected to rule on the validity of those waivers sometime this month. And coming up next in Inside Edition Weekend Investigation, how safe are you at the beach? How safe is the beach or the pool that you'll be taking your family to this weekend? Well, that depends on how well trained the lifeguards are who work there. As Matt Mehar found out, just having a lifeguard on duty does not guarantee your safety. On the world's most watched television show, it's hard bodies, hot romances, and happy endings. But that's not real lifeguarding. There's a lot of work. We train every winter. We go over our first responder course. We go through a pool practice. We do a lot of work just to stay fit. It's just like a fireman. We're then there when you need us. Sometimes we just sit around and we watch the girls, we watch the waves. But when we're needed, we're well trained and we respond. For 17 years, Andy Alty has been a lifeguard in Jacksonville Beach, Florida. It's one of the oldest and most respected programs in the country. Recruits there go through a grueling 12-week training course. We've been working together for 10 weeks and you're going to stop being a team all of a sudden? No, sir. And those who begin the training will drop out. You don't need to stop just because the tide's coming up. You're going to get wet on this job. Those who complete the program will join 100 guards who watch as many as 60,000 people on a busy weekend day. Whenever a guard leaves this tower, there's always four guys coming right behind him to help. I've been on several cases where it takes five, six people just to bring two people in. The Jacksonville Beach program cost hundreds of thousands of dollars to support. With dozens of lives saved every week, that seems like money well spent. But not every city trains or chooses their lifeguards this well, and that can lead to tragedy. In Atlantic City, New Jersey, two months ago, a lifeguard was indicted after an eight-year-old boy nearly drowned. The lifeguard had allegedly forged her lifeguard certificate. Charges are still pending. In New York City, the entire lifeguard program has come under attack. I mean, it's terrible for hateful ones to imagine that when someone's drowning and you can see help within reach and it's just not coming to you. Last fall, Dalton Agathe of Queens, New York won a million-dollar jury verdict against the city of New York. He maintained that his teenage son, Anthony, would still be alive today if a city lifeguard had responded properly when a riptide dragged Anthony and one of his friends out to sea off Rockaway Beach. A third boy, Roger Vaughn, escaped. He says the lifeguard was talking to a girl while his friends were drowning right in front of his chair. In this videotape deposition, he says the lifeguard argued with him when he told him his friends needed help. And I went to the one I was sitting on the bed, the lifeguard station, and told him, and he said, why the F did y'all come out here if y'all can't swim? The lifeguard testified that he had followed proper procedure and that the two boys who drowned had ignored his signals to come in. But the jury reportedly found that the lifeguard's slow reaction contributed to the boy's death. Very precious and valuable time was lost. He had no concern about, he had no concern for human life. Dolph Nagathy is not the only person critical of the New York City lifeguards. Last year, the Public Advocates Office released a scathing report on the system, citing special treatment in the testing and hiring of lifeguards, lifeguards who were not being retested every year as required, and in general, substandard training and enforcement. The report also blasts the New York City lifeguard training course because it only requires the guards to be tested in swimming pools, even if they're going to be assigned to beaches. I think what you need to do is give them a test and further train them for the location that you're working, because every location's a little different. Joe Pecoraro is the highly respected head of Chicago's 1,000 lifeguards. He says putting poorly trained lifeguards on duty is like flirting with death. It's like sending a policeman into a robbery without knowing how to fire a gun. On one note, if you catch a lifeguard not paying attention, you're advised to report him or her to a supervisor, but we should note, Madeline, that most lifeguards are very good at what they do. Unfortunately, there are those few you have to look out for. There are. And still to come, he has women going gaga over him, but what is Daniel Day-Lewis really like? And a fashion crisis. At least according to the author of a new biography on the film Star. He makes out that the man women fantasize about as their Prince Charming is anything but. I came to see what you were running away from. He's been called the thinking woman sex symbol. Daniel Day Lewis is a rare combination in today's Hollywood. A serious actor with classical training who's also become a genuine movie star. He's unlike any other actor of his generation in many ways in that he's completely consumed by the roles he undertakes. Gary Jenkins is the author of The Fire Within, an intimate look at this shy 39 year old. There's a small group of people who are very, very close to him who were slightly reticent about talking about him because he's very private. He's almost Garbo-esque. Perhaps this shyness came from being raised in the shadow of his father, Cecil Day Lewis, a respected novelist and one of England's poet laureates. His mother, Jill Balkan, came from one of England's most prestigious families. He grew up and took in as a child this incredible atmosphere, although that was very intimidating for him as well. The turning point in Lewis's life came when he was just 15 with the death of his father. His father had seen him act once at a school play, but he never saw him act again. This is something that's haunted Daniel Day Lewis ever since. As a young man, Lewis showed his versatility as an actor when he starred as a street punk in My Beautiful Laundrette and then in the same year took on the role of the stuck up Cecil Weiss in A Room with a View. He then secured leading man status as the womanizing surgeon Tomas in The Unbearable Lightness of Being. But it was his hypnotic portrayal of Christie Brown, the quadriplegic artist in the British film My Left Foot that caught the world's attention. For that he won the Oscar for best actor. What I loved about him is his fury, is the fact that he insisted on confronting things, confronting people's inability to deal with him every day of his life. Added to his credits was another Academy Award nomination for In the Name of the Father and a star was born. But when he got buff for Last of the Mohicans, he grew to sex symbol status. I don't think he sees himself as a sex symbol, that's not particularly what motivates him. I mean he's very much driven by the work. It was that drive that led him back to the British stage. During his performance as Hamlet in 1989, he was pushed to the edge. He basically broke down on stage one evening, mid soliloquy, never returned to the stage and hasn't returned to the stage since then. His personal life was just as rocky. His on again off again relationship with French actress Isabella Gianni left her with a baby boy born last April. And the relationship came to an end again shortly before she gave birth to the child in New York. This gave Lewis his first taste of bad publicity. He's been called a cat and a bander and a rotter. It has caused him probably the worst headlines of his career so far, that's for sure. And according to Jenkins, Lewis was romantically linked with Julia Roberts before her ill fated marriage to Lyle Lovett. It wouldn't surprise me at all if they were seeing each other again. I believe that there have been sightings of him leaving and entering her flat. This very private artist has shown the movie going public one thing. He's a star on the rise. His skills are developing with every movie that he takes on. He's getting better and better and better. And Lewis is a busy man these days. He's now working on a film version of the crucible. Deborah Norville has our report. As the riders, they come up towards the turn there. It began as a normal day of racing at Harold Park in Sydney, Australia, until. Something's gone wrong with the driver of Garlic Uprising. Steven Ward has either suffered a heart attack or something. He's fallen in the cart, and most of the field has gone over the top of him. A sensation here. In a spectacular racing accident, 70-year-old driver Steven Ward suffered a heart attack, which sent three other racers flying. We had a situation where we had driverless horses on the track, with the clerks, of course, trying to pick them up. But incredibly, Ward, who'd come out of retirement just four years ago, survived the crash after being twice resuscitated on the track. None of the horses were injured in the accident, and only minor injuries were suffered by the other drivers. Steven Ward has made an amazing recovery and is already out of the hospital. No word on his future racing plans, but you have to feel, Madeline, he'll probably be back. It'd take a lot of guts to do that in my book. And that's it for us today.
